of the Lease. Additional rent will be due and payable on a pro rata <br /> basis if additional Parking Spaces are leased pursuant to <br /> Archway's Option after an annual rent payment has already been <br /> made for a particular calendar year. Archway shall pay such <br /> additional rent for such additional Parking Spaces on or before the <br /> effective date specified in Archway's notice of exercise of its <br /> Option pursuant to Section 1.a above.;" <br /> is hereby amended to provide as follows: <br /> "Rent. The Rent shall vaty based on the number of Parking <br /> Spaces leased by Joyner pursuant to its Option at any time period <br /> at a rate of Ten Dollars ($10.00) per leased Parking Space per <br /> month if Joyner is leasing 27 or more Parking Spaces or at a rate of <br /> Twelve Dollars ($12.00) per leased Parking Space per month if <br /> Joyner is leasing less than 27 Parking Spaces. Joyner shall pay to <br /> the City the calculated rent based on the number of Parking spaces <br /> leased pursuant hereto. Rent shall be paid on a monthly basis in <br /> advance, with the first monthly payment due on the <br /> Commencement Date. Additional rent will be due and payable on a <br /> pro rata. basis if additional Pazking Spaces are leased pursuant to <br /> Joyner's Option after a monthly rent payment has already been <br /> made for a particular month. Joyner shall pay such additional rent <br /> for such additional Parking Spaces on or before the effective date <br /> specified in Joyner's notice of exercise of its Option pursuant to <br /> Section l.a above. <br /> 4. Joyner and Municipality agree and acknowledge that all other terms, <br /> conditions and covenants of the Lease, other than those amended herein, sha11 remain in <br /> full force an�effect. <br /> 5. Joyner and Municipality agree that this Amendment shall be attached to <br /> the Lease and, as of the date hereof,will be fully incorporated therein. <br /> 6. The Effective Date of this Amendment sha11 be the date first written <br /> above. <br /> 7. Each of the above said parties represents and warrants that each of the <br /> above said parties has the right and legal authority to execute this Amendment. Each of <br /> the above said parties further acknowledges and represents to one another that the <br /> representatives who execute this Amendment have the authority under the law to execute <br /> this Amendment and to bind their respective principals to the obligations under this <br /> Amendment and further, that any legal requirements conferring authority upon the <br /> representatives who execute this Amendment have been met by each of the respective <br /> parties as required by law. <br /> [THE REMAINDER OF THIS PAGE INTENTIONALLY LEFT BLANK]. <br /> 3 <br />
