•, • Book : ��23 Page : �63 <br /> � LEASE AGREEMENT <br /> I� JyI THIS LEASE AGREEMENT (the "Lease") is entered into this <br /> � day of August, 2008, by and between REYNOLDS <br /> DEVELOPMENT, LLC, a limited liability company (the "Developer") <br /> and the CITY OF DECATUR, an Illinois home rule municipal corporation <br /> (the "Municipality") pursuant to the terms of the Amendme�t to <br /> Redevelop ent Agreement between Developer and Municipality dated <br /> August , 2008 (the "Ame�dment"). <br /> RECITALS <br /> A. Developer and Municipality entered into that certain Redevelopment <br /> Agreement dated November 7, 2006 (the "Agreement"), for the <br /> purchase of the Premises located within the Development Area as <br /> described in Exhibit A to the Agreement in order to undertake a <br /> certain Development Project. <br /> B. Unless otherwise defined in this Lease, capitalized terms shall have <br /> the meanings assigned to them in the Agreement. <br /> C. Developer and Municipality amended the Agreement pursuant to the <br /> Amendment which, among other things, requires that Municipality <br /> execute a written lease agreement in substantially the form of this <br /> Lease to lease at least one hundred forty (140) parking spaces on the <br /> second floor in Municipality's parking deck located at the intersection <br /> of North Water Street and North Street to Developer, its anchor tenant <br /> Regions Bank, N.A., Consociate, Inc., Dansig, Inc., and other tenants <br /> of the building constructed on the Premises, with the following <br /> payment terms: (i) during the term of the Anchor Tenant Lease (first <br /> 15 years), parking will be available at no charge, and thereafter (ii) <br /> during any renewal term of the Anchor Tenant Lease (not to exceed 4 <br /> additional 5 year renewal terms), parking will be at an amount not to <br /> exceed $12.00 per space per month, which is what Regions Bank, , <br /> N.A.'s employees currently pay for parking in Municipality's parking ', <br /> garage C. �I <br /> The Amendment further requires that Municipality shall make an <br /> additional thirty (30) parking spaces in the Municipality's parking <br /> deck located at the intersection of North Water Street and North Street <br /> 1 <br />
