LEGAL DEPARTMENT MEMORANDUM <br /> NO. 2015-12 <br /> TO: Mayor Moore-Wolfe and City Council <br /> FROM: Tim Gleason, City Manager <br /> Wendy Morthland, Corporation Counsel <br /> DATE: October 19, 2015 <br /> SUBJECT: Lease and Buy-Back Macon County Health Department <br /> On the Agenda tonight is an Ordinance requesting that the City approve the Lease and <br /> Buy-Back Agreement between the Decatur Public Building Commission, the Macon County <br /> Board of Health, and Macon County. This Agreement pertains to the Macon County Health <br /> facility located at 1221 E. Condit St. in Decatur. <br /> The City Council must approve this Agreement pursuant to state statute. Specifically, <br /> 50 ILCS 20/14(a)(1)provides that the City Council, having adopted the original resolution for <br /> the creation of the Public Building Commission, must approve the selection, location, and <br /> designation of a site or sites being acquired for the erection, alteration, or improvement of the <br /> building, public improvement, or other facilities as well as any agreements relating to that. <br /> The Public Building Commission is asking the City Council to authorize and approve <br /> the Lease and Buy Back Agreement. There is no cost to the City nor will the City have any <br /> duties or responsibilities under the Agreement. <br /> Staff recommends approval of the Ordinance. Any questions can be directed to Wendy <br /> Morthland, Corporation Counsel. <br />
