LEGAL DEPARTMENT MEMORANDUM NO. 2015-12 TO: Mayor Moore-Wolfe and City Council FROM: Tim Gleason, City Manager Wendy Morthland, Corporation Counsel DATE: October 19, 2015 SUBJECT: Lease and Buy-Back Macon County Health Department On the Agenda tonight is an Ordinance requesting that the City approve the Lease and Buy-Back Agreement between the Decatur Public Building Commission, the Macon County Board of Health, and Macon County. This Agreement pertains to the Macon County Health facility located at 1221 E. Condit St. in Decatur. The City Council must approve this Agreement pursuant to state statute. Specifically, 50 ILCS 20/14(a)(1)provides that the City Council, having adopted the original resolution for the creation of the Public Building Commission, must approve the selection, location, and designation of a site or sites being acquired for the erection, alteration, or improvement of the building, public improvement, or other facilities as well as any agreements relating to that. The Public Building Commission is asking the City Council to authorize and approve the Lease and Buy Back Agreement. There is no cost to the City nor will the City have any duties or responsibilities under the Agreement. Staff recommends approval of the Ordinance.
