Excerpts from Plan Commission Meeting of October 1,2015:
Cal. No. 15-43 Petition of AKORN, INC. to rezone property
located at 1224, 1260, 1270, 1280 and 1290 WEST
GR.AND AVENUE and 1390 NORTH FAIRVIEW
AVENUE from R-3 Single Family Residence
District and B-1 Neighborhood Shopping District
to M-1 Intense Commercial/Light Industrial
District.
Ms. Stickle presented the recommendation of staff:
The subject site is approximately 4.7 acres and is located at 1224, 1260, 1270, 1280 and 1290
West Grand Avenue and 1390 North Fairview Avenue. The site is currently zoned R-3 Single
Family Residence District and B-1 Neighborhood Shopping District and is developed with
parking lots. Recently, there has been the demolition of a church and two small commercial
buildings.
The petitioner proposes to rezone from R-3 Single Family Residence District and B-1
Neighborhood Shopping District to M-1 Intense Commercial/Light Industrial District to allow
for all those uses permitted in the M-1 Intense Commercial/Light Industrial District.
The surrounding zoning includes B-2 Commercial District and M-1 Intense Commercial/Light
Industrial District to the east and R-3 Single Family Residence District to the north, south and
west. The Macon County and Decatur Comprehensive Plan shows this area as Retail and
Institutional. The permitted land uses in the M-1 Intense Commercial/Light Industrial District
are compatible with the land uses and adjacent zoning districts to the east.
Although the Comprehensive Plan shows this area as retail, staff is of the opinion that the
expansion of the M-1 zoning district to the west of the existing industrial use would not alter the
character of the general area.
If the property is rezoned to M-1 Intense Commercial/Light Industrial District and development
occurs, the adjacent properties will have a buffer yard between the residential properties and the
development in accordance with the regulations of the Zoning Ordinance.
Staff recommends approval of the rezoning.
Section XXIX. of the City of Decatur Zoning Ordinance requires the Plan Commission to hold a
public hearing on a rezoning request, and then forward its report and recommendation to the City
Council for final approval. A motion to forward Calendar Number 15-43 to the City Council
with a recommendation for approval is suggested.
Mr. Howard Miller, representative, was sworn in by Mrs. Poland.
Mr. Miller said Akorn has acquired the properties over the last few years and they are
reorganizing. They would like all of the properties zoned the same.
Mr. Jack Myatt asked if Akorn is planning on moving the driveway entrance to the existing
building. Mr. Miller said not at the time.
There were no objectors present.
It was moved and seconded (Harris/Sotirof to forward Calendar No. 15-43 to the City Council
with a recommendation for approval. Motion carried unanimously.
