• Agre�ment,an it�mi��d f�e s�hedul�pri�r ta the re�oval or the te�ing Qf t� a�tQ�ah�l�, sul�ic� itemized fee schedule shall be consistent in all res ects with the amounts set forth in the schedule P incorporated herein as Exhibit A, which fees,rates and charges shall not exceed the amounts of the bid provided by Prairieland to the City in relation to this Agreement. 7. Equipment Provided by Prairieland. Prairieland shall provide a minimum of five(5)radio dispatched towing vehicles,dispatched from a manned point base station on a twenty- four (24) hour basis, seven (7) days per week. In addition to the foregoing, for snow emergency routes,Prairieland shall provide a minimum of five(5)radio dispatched towing vehicles on no less than five(5)hours notice provided by the City of the need thereof. Prairieland shall maintain at least one radio dispatched towing vehicle capable of lawfully towing commercial vehicles of fully loaded maximum road weight and a flatbed truck to transport vehicles incapable of being towed. Prairieland also shall provide or make provision for a"non-public" private telephone line between the communications center of the I�ecatur Po?ice�epartment and Prair�eland for emergency use. 8. Response Time. Prairieland shall provide for radio dispatched towing vehicle average response time of no longer than twenty(20)minutes with a ma�cimum of thirty(30)minutes, subject to reasonable requirements and potential emergencies and circumstances beyond the.c.ontrol of Prairieland. Requests by the City for towing and storage services hereunder shall take priority over other towing services of Prairieland, except towing services provided other law enforcement agencies or emergencies. 9. Prairieland Services. Upon the request of a sworn officer of the Decatur Police Department or other lawful impoundment officer,Prairieland shall remove and/or impound any vehicle,not owned or leased by the City,from the streets of the City or adjacent areas. Vehicles subject to holds placed thereon by the Decatur Police Department shall be stored by Prairieland subject to the reasonable direction of the Decatur Police Department or as may be directed by a court of competent jurisdiction. Vehicles towed and/or stored pursuant to the terms hereof,which vehicles are not subject to a"hold"placed thereon by the Decatur Police Department, shall be released in accordance with the provisions of§ 16 hereof. In addition,in the case of a�rehiculaz collision or automobile acc;dent,�uhere the ouuner Qr operator,for whatever reason is incapacitated or otherwise incapable of approving a towing service, or the owner or operator does not request the services of a specific towing services company, and the Decatur Police Department is authorizing the provision of towing andlor storage services,the Decatur Police Department will contact Prairieland to perform the towing and/or storage services, and Prairieland shall provide such services. Prairieland also shall provide towing services for periodic Decatur Police Department auctions upon notice of not less than seventy-two (72)hours. Prairieland also will work diligently with the city in order to provide four (4) radio dispatched towing vehicles for the "Streets for -4-
