' ��a��t�it��easo�ah�e�i��ccriptian af t���u�ces prauid��. �'he �ity�uill r��it payment th�r�Qn <br /> in due course, not to exceed thirty(30) days after receipt of the invoice in accordance herewith. <br /> Notwithstanding anything to the contrary herein, the City shall remit, pay and deliver to <br /> Prairieland monies in satisfaction of invoices tendered to the City for Praireland's use of any Heavy <br /> Duty Tow Vehicle for towing of City vehicles(referred to as Category 2 of the bid pursuant to which <br /> the present Agreement is executed) at the hourly rate of Eighty-five Dollars ($85.00) for such use. <br /> 13. Collection of Fees and Charges. The City is not responsible to Prairieland for <br /> the collection of fees and charges incurred in the towing and/or storage of vehicles subject to the <br /> terms of this Agreement (except as such services may be provided to the City as set forth in § 12 <br /> hereo�. However, the City recognizes that Prairieland is entitled to compensation for the services <br /> rendered hereunder, and subject to the provisions hereof the City shall not act in anv manner or <br /> fashion to impair,harm, lessen or compromise any lien or claim Prairieland may possess by law or <br /> agreement or the right af Prairieland ta receive payment for the services described herein sa lerg as <br /> such fees and charges are set forth in Schedule A attached hereto. Notwithstanding anything to the <br /> contrary herein, the City may act to protect the integrity of evidence necessary for actions by the <br /> Decatur Police Department. �i <br /> 14. Complaints. Praixieland shall provide a consumer compiaint procedure available <br /> to individuals or entities dealing with Prairieland in relation to the subject matter hereof, which <br /> procedure shall include a written document to be completed by the individual or entity dealing with <br /> Prairieland in a form substantially similar to that exemplar attached hereto and made a part hereof <br /> as Exhibit B. Prairieland will provide to the Decatur Police Department a copy of any written <br /> consumer complaint received by Prairieland in relation to Prairieland services provided hereunder. <br /> Should any individual or entity complain in writing to the City or the Decatur Police Department <br /> about Prairieland in the performance of duties set forth herein, the City (or the Decatur Police <br /> Department, as the case may be) shall deliver to Prairieland,within fourteen(14)days after receipt <br /> thereof, a copy of said complaint. <br /> 15. Personal Propertv Contained Within Vehicle. Prairieland shall provide a <br /> reasonable means for individuals having the lawful right of immediate possession of personal <br /> property, excluding accessions to said vehicles, contained within vehicles towed and/or stored <br /> pu�suant to th�tenns af t�s Agreement t�oht�in pc�ssess�an there,of. If an item of persc�nal pa'apgrlY <br /> is identified to Prairieland for release,and such item is of a nature as to be,or transportation thereof <br /> may be, suspicious, dangerous, unlawful or illegal, Prairieland may conta.ct the Decatur Police <br /> Department rather than release the item immediately to the person requesting release thereof. In the <br /> case of contraband, Prairieland is likewise permitted to deliver the same to the possession of the <br /> Decatur Police Department rather than releasing the same to the person requesting its release. <br /> Prairieland may demand reasonable identification frozn such individual claimants (by way <br /> of example and not excluding other means, photographic identification such as a valid driver's <br /> license)and demand further that said claimants reasonably identify the personal property for which <br /> -6- <br />
