R2008-40 RESOLUTION AUTHORIZING UPGRADING OF ACTIVE WARNING DEVICES WITH NORFOLK SOUTHERN RAILWAY COMPANY AND ILLINOIS DEPARTMENT OF TRANSPORTATION -RAILROAD TRACK CROSSING AT SUNNYSIDE ROAD (FAU7422)- WHEREAS, this resolution authorizes the City of Decatur to enter into an Agreement with Norfolk Southern Railway Company and Illinois Department of Transportation for the Upgrading of Active Warning Devices for the Railroad Track Crossing at Sunnyside Road (FAU7422). BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DECATUR, ILLINOIS: Section 1. That the Upgrading of Active Warning Devices Agreement relating to the Railroad Track Crossing at Sunnyside Road (FAU 7422) presented to the City Council herewith between the City of Decatur and Norfolk Southern Railway Company and Illinois Department of Transportation for the installation of crossing gates and the incidental work necessary to complete the installation of crossing gates of the Norfolk Southern Track Crossing at Sunnyside Road (FAU7422) be, and it is hereby, received, placed on file and approved. Section 2. That as part of the Agreement, Illinois Department of Transportation requires that the City agrees to provide at its expense any necessary advance warning signs and pavement markings as required by the MANUAL ON LJNIFORM TRAFFIC CONTROL DEVICES. When a marked traffic detour is required, the City at its expense shall furnish, erect, maintain, and remove the traffic control devices necessary to detour highway traffic. Section 3. That the Mayor and City Clerk be, and they are hereby, authorized and directed to sign said Upgrading of Active Warning Devices Agreement on behalf of the City of Decatur.
