c. $ 50,000 (one-third of total payment) upon Artist's notice to <br /> DECATUR of the completion of the sculpture in bronze or bronze and stainless <br /> steel, depending upon the design selected. <br /> 3. The Artist shall be responsible for the transportation of the Artwork to a <br /> designated location in Decatur, Illinois. DECATUR shall be responsible for the base <br /> and installation for the sculpture. <br /> W. The Artist warrants that the Artwork shall be a unique and original product of <br /> the Artist's creative efforts, that there will be only one edition except as specified <br /> herein or by other written agreement of the parties, that the Arlwork has not been <br /> accepted for sale elsewhere, and that DECATUR shall own the Artwork, upon <br /> delivery, free and clear. Until full and final payment is made, and the sculpture is <br /> delivered to an agreed-upon location in Decatur, all rights, title and interest in the <br /> artwork shall be held by the Artist. <br /> � Both parties agree that completion date for the sculpture will be on or before <br /> October 31, 2008. If the location of the sculpture site is not yet complete by this <br /> time, the City of Decatur may extend the completion date by notifying the sculptor, <br /> or his designated agent not less than sixty (60) days before said due date. <br /> /�. Once the specific design has been determined, a sketch of the selected design will <br /> be attached and incorporated into this agreement with a copy of said selected <br /> design being provided by the artist. It is understood that the sketch is a general <br /> representation of the arlwork to be completed. The Artist may make changes to the <br /> design or imagery depicted at his discretion. The �inal design is subject to approval <br /> by the City of Decatur. <br />
