R2007-212 <br /> Approving Pro Forma Assignment of Franchise To <br /> Illinois/Indiana Systems Group, LLC and Change of <br /> Control of Illinois/Indiana Svstems Group, LLC <br /> Background Regarding Franchise Renewal <br /> WHEREAS, <br /> 1. On or about August 1, 1988 the City of Decatur, Illinois ("City") adopted <br /> Ordinance No. 88-59 granting a Cable Television Franchise ("Franchise") to <br /> UACC Midwest, Inc.; and, <br /> 2. The Franchise is now held by Insight Communications Midwest, LLC ("Grantee") <br /> which owns and operates the cable television system (the "System"); and, <br /> 3. By letter dated September 12, 2000, Grantee requested that the City commence <br /> renewal proceedings in accordance with the 47 U.S.C. § 546 (a); and, <br /> 4. The City thereafter commenced renewal proceedings in accordance with 47 <br /> U.S.C. § 546 (a). The original term of the Franchise expired on or about August <br /> 1, 2003, however, Grantee continues to operate the System in the City pursuant <br /> to the terms of the Franchise consistent with its rights under 47 U.S.C. § 546; <br /> and, <br /> 5. The City and Grantee pursued renewal through informal negotiations and <br /> through the formal renewal process under 47 U.S.C. §546; and, <br /> 6. The City issued a Formal Needs Assessment Report ("Needs Assessment") on <br /> February 21, 2006 and established April 24, 2006 as a deadline for Grantee's <br /> response to the Needs Assessment; and, <br /> 7. On or about April 24, 2006 Grantee submitted to the City its Formal Proposal in <br /> response to the Needs Assessment ("Proposal"); and, <br /> ' 8. Pursuant to 47 U.S.C. § 546(c) the City had four (4) months from April 24, 2006 <br /> within which to either renew Grantee's Franchise or issue a preliminary <br /> assessment that the Franchise should not be renewed; and, <br /> �oiiiaov� 1 <br />
