The <br /> City further agrees to be responsible for any and all costs to provide ingress and <br /> egress to the Subject Property and to secure any and all utility connections <br /> and/or relocations necessary due to the Oakland Avenue extension. <br /> 6. WATER SUPPLY AND SERVICE. (a) After securing all <br /> necessary permits from the Illinois Environmental Protection Agency, Primrose <br /> shall be permitted to connect to existing City water mains as described by the <br /> City's Director of Engineering and Infrastructure. The City agrees to waive any <br /> and all tapping fees for water supply services. <br /> (b) Primrose shall use and exercise all reasonable means and facilities <br /> to install water transmission lines (the Water Lines) within the Subject Property <br /> sufficient to carry an adequate supply of water to service the Subject Property. <br /> Said lines shall be constructed in accordance with City standards and all <br /> n r in <br /> a licable Cit codes a d o d ances. <br /> Pp Y <br /> 7. SEWERS, DRAINAGE AND TREATMENT FACILITIES. (a) <br /> Primrose shall be responsible for securing all necessary permits from the Illinois <br /> Environmental Protection Agency and the Decatur Sanitary District to connect to <br /> the existing sanitary sewer owned by said District. <br /> (b) Primrose shall use and exercise all reasonable means and facilities <br /> to install sanitary sewer lines within the Subject Property sufficient to serve the <br /> Development. Said lines shall be constructed according to plans approved by <br /> the City's Director of Engineering and Infrastructure. I <br /> (c) Primrose shall cause the Development Parcel to be annexed to the <br /> Decatur Sanitary District prior to making any sewer connections and shall pay <br /> any necessary annexation fees. <br /> (d) The City shall reimburse Primrose Forty-Five Thousand Dollars <br /> ($45,000.00) incurred to extend the sanitary sewer line to the Subject Property. <br /> 8. DEDICATION OF IMPROVEMENTS. (a) Primrose hereby <br /> dedicates to the City those sanitary sewers constructed in the utility easements <br /> shown on the Planned Development Documents. The City shall accept such <br /> improvements by approval of the Planned Development Documents for the <br /> Subject Property if the sewers are constructed after approval of the final <br /> construction. <br /> 9. REIMBURSEMENT TO PRIMROSE. (a) The City shall reimburse <br /> to Primrose the agreed upon amount set forth in Paragraph 7(d) herein. Such <br /> reimbursement shall be paid by the City to Primrose solely from that portion of <br /> the real estate taxes actually received by the City in any year attributable to the <br /> increase in the equalized assessed valuation of the Subject Property in the tax <br /> 3 <br />
