During the term of this agreement, the City shall transport recyclable materials <br /> suitable for composting which are or collected or transported by City within the Illinois <br /> County of Macon to Evans' composting facility, except for materials it retains for its use <br /> or to make available to its citizens. <br /> 3. City agrees to deposit said recyclable materials suitable for composting at said <br /> composting facility pursuant to the rules of the facility. <br /> 4. City agrees to pay Evans for the depositing of said recyclable materials suitable <br /> for composting at the rates shown on Exhibit A for material deposited during the peak <br /> season of October 15th through and including January 15t" of each year during the term <br /> of this agreement AND at the rates shown on Exhibit A for material deposited during the <br /> general or balance of each year during this term of this agreement. <br /> 5. City agrees to comply with any and all rules of the compost facility relating to <br /> operations upon and around the compost facility. <br /> 6. City agrees to pay Evans within 30 days of date of invoice. <br /> 7. City agrees to pay finance charges, late fees, court costs and reasonable <br /> attorney's fees relating to invoiced fees remaining unpaid for more than 30 days. <br /> 8. Evans agrees to accept for disposal all segregated, recyclable materials suitable <br /> for composting for which Evans is permitted to accept pursuant the laws, rules and <br /> regulations of the Illinois Environmental Protection Agency which are transported to <br /> Evans' composting facility by City pursuant to the terms of this agreement. <br /> 9. Evans agrees to mail to City invoices for fees incurred by City pursuant to this <br /> agreement. <br />
