("FS") WITNESSETH: <br /> WHEREAS City Water Treatment Plant lagoons accumulate large <br /> quantities of lime sludge that must be removed periodically as part of the water <br /> treatment process, and; �! <br /> WHEREAS City desires to secure a reliable provider of lime sludge <br /> removal services at a reasonable and guaranteed price, and; <br /> WHEREAS FS has the product knowledge, experience, local farm <br /> knowledge, and capability to fulfill the City's lime sludge removal requirements, <br /> and; ' <br /> WHEREAS FS is the responsible bidder which submitted the responsive <br /> bid with the lowest price term. <br /> NOW THEREFORE, City and FS agree as follows: <br /> 1. The provisions of the City's "INVITATION TO BID", including "NOTICE <br /> TO BIDDERS"; "TERMS & CONDITIONS"; "SPECIAL PROVISIONS"; <br /> "BIDDER'S PROPOSAL (as completed and submitted by FS); "BID SIGNATURE <br /> PAGE"; "NON-COLLUSION AFFIDAVIT OF PRIME BIDDER"; and "EQUAL <br />
