. �. RESOLUTION NO. R2007-14 AUTHORIZE RECOMMENDATION ON QUESTIONS OF LAW INSIGHT COMMUNICATIONS MIDWEST, LLC FRANCHISE RENEWAL WHEREAS, on August 1, 1988 the City of Decatur, Illinois ("City") adopted Ordinance No. 88-59 granting a Cable Television Franchise ("Franchise") to UACC Midwest, Inc.; and WHEREAS, the Franchise is currently held by Insight Communications Midwest, LLC ("Insight"); and WHEREAS, the Franchise expired on or about August l, 2003; and WHEREAS, Insight has requested that the City renew its Franchise; and WHEREAS, the City has commenced renewal procedures in compliance with 47 U.S.C. § 546; and WHEREAS, the City and Insight initially engaged in informal renewal negotiations pursuant to 47 U.S.C. § 546(h) but were unable to arrive at mutually acceptable terms; and WHEREAS, the City issued a Formal Needs Assessment Report ("Needs AssessmenY') on February 21, 2006; and WHEREAS, the City established April 24, 2006 as a deadline for Insight's response to the Needs Assessment; and WHEREAS, on or about April 24, 2006 Insight submitted to the City its Formal Proposal in response to the Needs Assessment ("Proposal"); and WHEREAS, pursuant to 47 U.S.C. § 546(c) the City has four (4) months from April 24, 2006 within which to either renew Insight's Franchise or issue a preliminary assessment that the Franchise should not be renewed; and WHEREAS, on July 3, 2006 the City adopted Resolution No. R2006-93 issuing a ' Preliminary Assessment that Insight's Franchise should not be renewed; and '
