The Honorable Paul Osborne
July 26, 2006
Page 2
liability insurance policy and provide to the City a certificate indicating the existence of such
coverage.
The remainder of the Amendment is fairly consistent with prior amendments.
Please note that the Amendment includes an Effective Date of that date upon which the City
Council approves the Amendment at a lawfully called meeting thereof, after which you (or such
other designee as selected by the City)are to insert the date into the opening paragraph and execute
the Amendment on behalf of the City. Following execution of the Amendment by the Employee
(and attestation by the City Clerk),we respectfully request that the City return to us a fully executed
copy of the Amendment for our records.
We also request that the City strongly consider the benefit(s)of preparing a single document
to govern the relationship between the City and the Employee. We believe that a single document
would provide a better understanding (and maintenance of that understanding) of the contractual
relationship between the City and the Employee rather than the use of multiple amendments to a
contract originally executed in September of 1999. From our telephone conversation,we understand
that the City presently wishes to utilize a further amendment to define the City's relationship with
the Employee, and for such reason we prepared the Amendment.
Thank you for allowing us to provide service to the City. Should you have any questions,
require additional information,or we may be of further assistance to you,we ask that you not hesitate
to contact us at your earliest convenience.
Very truly yours,
Kehart, Peckert& Booth
i
BY:
James E.
