SANITARY SEWER SERVICE AGREEMENT <br /> For and in consideration of the undertakings and covenants set out herein, it is agreed <br /> by and between the Owner(s) of the Deer Run Subdivision described at paragraph 9 hereof, <br /> and which person or persons are signatory hereto, ("Owner"), and the CITY OF DECATUR, <br /> ILLINOIS, ("City"), as follows: <br /> 1. The provisions of this Agreement, and the installation, operation and use of the , <br /> sanitary sewer service authorized hereby, are expressly made subject to all applicable � <br /> provisions of codes, ordinances, rules and regulations of the City, and the Owner agrees to , <br /> comply therewith. ' <br /> 2. After completion of the construction of a sanitary sewer main by the Owner in � <br /> the public right-of-way or easement adjacent to or within the subdivision described herein, <br /> and upon obtaining acceptance by the City of Decatur and tapping permits for each individual <br /> lot in the customary manner followed by the City for subdivisions within its corporate limits, <br /> Owner(s) may tap said sanitary sewer main which has been accepted by the City and <br />' connect a sanitary sewer service thereto to furnish residential service only to lots within said <br /> subdivision. <br /> 3. Said tap, connection, and service shall be made and installed by a licensed <br /> plumber. <br /> 4. The Owner agrees to annex to the Sanitary District of Decatur and to pay all <br /> sewer service charges to the Sanitary District of Decatur and the City of Decatur when <br /> periodically billed for said services. <br /> 5. The Owner(s) agree that the City's Sewer User Charge Rate shall be double <br /> the Standard rate charged for properties within the City's corporate limits and shall pay the <br /> double rate until such time that the properties in the subdivision are annexed into the City. <br /> 6. At such time as any portion of said subdivision becomes contiguous to the <br /> corporate limits of the City, the then owner(s) of all properties within said subdivision shall, <br /> within ninety (90) days after receiving notice from City thereof, petition to annex the same to <br /> the City. If a petition is not received within the time period, or the property is not annexed as a <br /> result of the petition, sanitary sewer service to the premises will be terminated. <br /> 7. This agreement shall terminate upon the failure by Owner(s) of any said <br /> subdivision or of any properties within said subdivision to comply with any provision hereof or <br /> with any applicable provision of the City Code, ordinances, rules or regulations, or upon the <br />
