COUNCIL COMMUNICATION FORM Engineering & Infrastructure Memorandum NO. 2006-50 August 3, 2006 TO: Honorable Mayor Osborne and City Council FROM: Steve Garman, City Manager � � Stephen Swanson, P.E.,Director o ngineering & Infrastructut� SUBJECT: Deer Run Subdivision Sanitary Sewer Agreement The City Council at its meeting of July 17, 2006, tabled the Council Agenda Item for an Outside Sanitary Sewer Service Agreement with the developer of the Deer Run Subdivision. This item is being returned to the City Council for action at this time. A copy of the July 7, 2006, memorandum from City staff to the City Council is attached for information and reference. At the July meeting City Council members asked about the potential economic impact to the City in , entering into the agreement as the subdivision is outside the City's corporate limits. For this reason i it was being asked if there might be extraordinary costs to the City's operations associated with the ' sewer. The questions basically related to the costs the City would incur for maintenance and any major repair costs if the sewer experienced a major problem. In response to questions about regular maintenance, staff commented that the additional cost would , be negligible for the first 5 to 10 years. The basis for this response was staff's experience with new sewers that are designed and constructed to current City standards and specifications. Questions about any costs for major repairs were more difficult to address. The difficulty relates to trying to predict or estimate for an event that is considered a remote possibility. This relates to the controls exercised in the design and construction activities to avoid the major failure of new sewers. Major failures that result from an event other than design or construction related causes might be from an earthquake, an illegal act by someone causing damage to the sewer or a manmade or natural event causing major damage to the sewer. Again, these are considered to be remote possibilities by staff. In the City Council's discussion of the proposed agreement, the basic comment expressed was that the developer should share in the risk with the City. It was generally at this point in the discussion that the City Council decided to table the item. Mr. John Drayton, the developer, spoke with City staff shortly after the meeting about the questions and concerns expressed by the City Council at their meeting. He shared with staff a draft letter he was planning to send to each member of the City Council and the City Manager prior to leaving town on vacation. In his letter, he provided background and additional information he thought important for the City Council members to know and should consider in taking action on this item.
