Equal Employment Opportunity <br /> The Recipient certifies that it will comply with the Illinois Human Rights Act, the <br /> Americans with Disabilities Act, the Rules and Regulations of the Illinois Department of <br /> Human Rights, Civil Rights Act of 1964, Department of Labor regulations (41 CFR Part <br /> 60), and any other laws, regulations or orders, state or federal, which prohibit <br /> discrimination on the grounds of race, sex, color, religion, national origin, or handicap. <br /> In the event of the Recipient's noncompliance with any provision of any such law. <br /> regulation or order, the Recipient may be declared non-responsible and therefore <br /> ineligible for future financial assistance agreements or subcontracts with the State of <br /> Illinois or any of its political subdivisions or municipal corporations, and the Agreement <br /> may be canceled or voided in whole or in part, and such other sanctions or penalties <br /> may be imposed or remedies invoked as provided by statute or regulation. <br /> 8. Contracting with Small and Minority Firms,Women's Business Enterprise and <br /> Labor Surplus Area Firms <br /> The Recipient certifies that it will take all necessary affirmative steps to assure that <br /> minority firms, women's business enterprises, and tabor surplus area firms are used <br /> when possible. <br /> Affirmative steps shall include: <br /> (i) Placing qualified small and minority businesses and women's business <br /> enterprises on solicitation lists; <br /> (ii) Assuring that small and minority businesses, and women's business enterprises • <br /> are solicited whenever they are potential sources; <br /> (iii) Dividing total requirements, when economically feasibte, into smaller tasks or <br /> quantities to permit maximum participation by small and minority business, and <br /> women's business enterprises; <br /> (iv) Establishing delivery schedules, where the requirement permits, which <br /> encourage participation by small and minority business, and women's business <br /> enterprises; <br /> (v) Using the services and assistance of the Small Business Administration and the <br /> Minority Business Development Agency of the Department of Commerce; and <br /> (vi) Requiring the prime contractor, if subcontracts are to be let, to take the <br /> affirmative steps as listed in paragraph (i) through (v) of this section. <br /> The Recipient will complete and submit to the Illinois EPA the form entitled "MBE/WBE <br /> Utilization Under Federal Grants, Cooperative Agreements and Other Federal Financial <br /> Assistance", (Form 334), fifteen days after the end of each calendar quarter year. <br /> Conditions/Certifiqtions <br /> March 2005 <br />
