AGREEMENT <br /> , <br /> ; <br /> � <br /> This Agreement made this ���� day of � �"�'`- , 2006 by and between the <br /> City of Decatur, Illinois ("City"), a municipa �orporatio , and the Macon County Health <br /> Department, ("Department"). ` <br /> Whereas, the City owns and operates an 800 MHz Radio System(the "System") for use in <br /> dispatching law enforcement and fire and rescue services by various public agencies; and, <br /> Whereas, the Department wishes to have access to the System such that those radios used <br /> by personnel of the Macon County Health Department can communicate with the System and <br /> �:��fth��ther users of the System; and, <br /> Whereas, the City is willing to grant the Macon County Health Department such access, <br /> on the terms and conditions set out herein. <br /> NOW, THEREFORE, for and in consideration of the provisions hereof, the City and the <br /> Department agree as follows: <br /> l. The System is hereby defined as that 800 MHz radio system owned and operated by <br /> the City, the dispatch center for which is located in the Law Enforcement Center, 333 S. Franklin <br /> Street, and includes but is not ]imited to all towers, transmitters, receivers, controllers, � <br /> microwave transmitters/receivers, computers, software and firmware, electronic circuit boards i,, <br /> and all other components located in any part of the System, as well as the power supply thereto I <br /> and the physical facilities supporting or housing the same. The System does not include portable <br /> or mobile radio transmitters/receivers owned by any entity other than the City. <br /> 2. Subject to compliance with all of the terms and conditions of this Agreement, the City <br /> hereby grants to the Macon County Health Department access to the System for those radios used <br /> by the Macon County Health Department. The Department shall not allow the use of said radios <br /> by any other individual or entity that is not directly employed by the Department, except with the <br /> wriiten apprcvai oi the c,ity. <br /> 3. For access to the System as herein provided, the Department shall pay to the City a <br /> monthly fee of Four pollars ($4.00) per radio which has been programmed to be used on the <br /> System regardless of the level of use or activity of that radio. The monthly fee shall Ue paid <br /> within ten (10) days after the first day of each month for which the fee is in effect. The monthly <br /> fee shall be in effect as of the earliest date any Department radio was programmed to work within <br /> the System. <br /> 4. The Department shall be limited to no more than five (5) radios to be programmed for <br /> utilization on the System. The City reserves the right to increase said monthly per radio charge, <br /> with thirty (30) days written notice, if the Department exceeds this limitation. Additionally, the <br /> City reserves the right to increase the monthly per radio fee, based on Department's usage as a <br />
