� <br /> RESOLUTION NO. R2006-93 <br /> PRELIMINARY ASSESSMENT THAT INSIGHT � <br /> COMMUNICATION MIDWEST LLC'S FRANCHISE SHOULD NOT BE RENEWED <br /> WHEREAS, on August 1, 1988 the City of Decatur, Illinois ("City") adopted <br /> Ordinance No. 88-59 granting a Cable Television Franchise ("Franchise") to UACC Midwest, <br /> Inc.; and <br /> WHEREAS, the Franchise is currently held by Insight Communications Midwest, <br /> LLC ("Insight"); and <br /> WHEREAS, the Franchise expired on or about August 1, 2003; and <br /> WHEREAS, Insight has requested that the City renew its Franchise; and <br /> WHEREAS, the City has commenced renewal procedures in compliance with 47 <br /> U.S.C. § 546; and <br /> WHEREAS, the City and Insight initially engaged in informal renewal negotiations <br /> pursuant to 47 U.S.C. § 546(h) but were unable to arrive at mutually acceptable terms; and <br /> WHEREAS, the City issued a Formal Needs Assessment Report ("Needs <br /> Assessment") on February 21, 2006; and <br /> WHEREAS, the City established April 24, 2006 as a deadline for Insight's response <br /> to the Needs Assessment; and <br /> WHEREAS, on or about April 24, 2006 Insight submitted to the City its Formal <br /> Proposal in response to the Needs Assessment("Proposal"); and <br /> WHEREAS, pursuant to 47 U.S.C. § 546(c) the City has four (4) months from April <br /> 24, 2006 within which to either renew Insight's Franchise or issue a preliminary assessment that <br /> the Franchise should not be renewed; and <br /> WHEREAS, the City has carefully reviewed Insight's Proposal and has determined a <br /> number of areas where the Proposal fails to meet the future cable-related community needs and <br /> interests taking into account the cost of ineeting such needs and interests; and <br />
