4. The water main extension will proceed through, on, within, or under, public rights
<br /> of way for Taylor Street and North Street in Elwin, South Wheatland Township, Macon County,
<br /> Illinois, which South Wheatland Township has jurisdictional control. Earl H. Peterson, Road
<br /> Commissioner, South Wheatland Township, has provided written consent, a copy attached hereto
<br /> as Exhibit "D."
<br /> 5. The City hereby waives all water tapping fees and charges, including any
<br /> inspection fees and charges, in connection with the water service to be provided to the Property
<br /> (1582 W. Elwin Road), including to service any facilities located on the portion of the Property
<br /> zoned M-1 and any residential property located on the portion of the property zoned R-1. In
<br /> addition, at such time in the future that city water service is extended to residents of Elwin
<br /> located along the south side of Elwin Road, the City hereby agrees to waive all water tapping
<br /> fees and charges, including all inspection fees and charges for two other properties owned by
<br /> Owner, said properties located at 1561 W. Elwin Road (currently Owner's business office) and
<br /> 1575 W. Elwin Road (currently Owner's residence), each of said additional properties located in
<br /> Elwin, Illinois and having a property address for Macon County Enhanced 911 Emergency
<br /> Telephone System purposes, respectively, of 1561 W. Elwin Road, Decatur, IL 62521 and 1575
<br /> W. Elwin Road, Decatur, IL 62521, as per copies of July 9, 2001 correspondence from Daniel
<br /> W. Sanner, Director of Macon County Emergency Telephone System Board, attached hereto as
<br /> Exhibits "E" and "F."
<br /> 6. Water service pipes shall conform to city codes, standards and specifications and
<br /> the Illinois State Plumbing Code Standards. Water service pipes shall be traceable by means of a
<br /> metal detector. Following execution of this Agreement, City shall promptly and diligently
<br /> proceed to provide Owner with written confirmation, or objection, that the Water Main Plan
<br /> attached hereto as Exhibit "C" conforms or does not conform to all city codes, standards and
<br /> specifications and the Illinois State Plumbing Code Standards. In the event City has any
<br /> objection to said Water Main Plan, City shall promptly notify Owner and Steven M. Baumann,
<br /> P.E. of the specific objection and any modification of the plan necessary to achieve conformance
<br /> and approval of the City to said plan. The City designates its City Engineer, currently Matthew
<br /> Newell, or his successor, as the contact person at the City for any inquiries, notices, or demands
<br /> to the City relating to this Agreement for Water Service.
<br /> 7. All work and materials relating to a water service shall conform to city standards
<br /> and specifications and be performed by a licensed plumber of Owner's choice.
<br /> 8. Water services shall be metered in accardance with city standards and ��
<br /> specifications. '�
<br /> 9. The provisions of this Agreement, and the installation, operation and use of the
<br /> water service authorized under this Agreement is specifically made subject to all of the
<br /> applicable provisions of the codes, ordinances, rules and regulations of the City, and Owner
<br /> agrees to comply therewith.
<br /> 10. At the option of the City, the City may install or have installed a fire hydrant at
<br /> the west end of the water main extension, as depicted on the attached Water Main Plan, at the
