WATER SERVICE AGREEMENT <br /> For and in consideration of the undertakings and covenants set out herein, it <br /> is agreed by and between the Owner(s) of the Deer Run Subdivision described at <br /> paragraph 9 hereof, and which person or persons are signatory hereto, ("Owner"), <br /> and THE CITY OF DECATUR, ILLINOIS, ("City"), as follows: <br /> 1. The provisions of this Agreement, and the installation, operation and use <br /> of the water service authorized hereby, are expressly made subject to all applicable <br /> provisions of codes, ordinances, rules and regulations of City, and the Owner <br /> agrees to comply therewith. <br /> 2. After the construction of a water main by the Owner within public right- <br /> of-way or adjacent to the Subdivision described herein, and upon obtaining <br /> acceptance by the City and tapping permits for each individual lot in the customary <br /> manner followed by the City for subdivisions within its corporate limits, the Owner <br /> may tap said water main which has been accepted by the City and connect water <br /> services thereto to furnish residential services only to lots within said subdivision. <br /> 3. Said taps, connections, and services shall be made and installed by a <br /> licensed plumber. <br /> 4. The water furnished by the City shall only be used for domestic purposes <br /> and only upon the premises described herein. <br /> 5. At such time as any portion of said subdivision becomes contiguous to <br /> the corporate limits of the City, the then owner(s) of all properties within said <br /> subdivision shall, within ninety (90) days after receiving notice from City thereof, <br /> petition to annex the same to the City. If a petition is not received within the time <br /> period, or the property is not annexed as a result of the petition, water service will <br /> be immediately terminated without further notice. <br /> 6. This agreement shall terminate upon the failure by Owner of said <br /> subdivision or of any properties within said subdivision to comply with any !, <br /> provision hereof or with any applicable provision of the City Code, ordinances, I <br /> rules or regulations, or upon the annexation of said subdivision to the City, and '�, <br /> may be terminated by either party upon six (6) months notice by certified mail to <br /> the City, or to the property owner(s) within said subdivision. <br /> 7. A copy of this Agreement shall be made a part of the Owner's <br /> Declaration. <br />
