WATER SERVICE AGREEMENT For and in consideration of the undertakings and covenants set out herein, it is agreed by and between the Owner(s) of the Deer Run Subdivision described at paragraph 9 hereof, and which person or persons are signatory hereto, ("Owner"), and THE CITY OF DECATUR, ILLINOIS, ("City"), as follows: 1. The provisions of this Agreement, and the installation, operation and use of the water service authorized hereby, are expressly made subject to all applicable provisions of codes, ordinances, rules and regulations of City, and the Owner agrees to comply therewith. 2. After the construction of a water main by the Owner within public right- of-way or adjacent to the Subdivision described herein, and upon obtaining acceptance by the City and tapping permits for each individual lot in the customary manner followed by the City for subdivisions within its corporate limits, the Owner may tap said water main which has been accepted by the City and connect water services thereto to furnish residential services only to lots within said subdivision. 3. Said taps, connections, and services shall be made and installed by a licensed plumber. 4. The water furnished by the City shall only be used for domestic purposes and only upon the premises described herein. 5. At such time as any portion of said subdivision becomes contiguous to the corporate limits of the City, the then owner(s) of all properties within said subdivision shall, within ninety (90) days after receiving notice from City thereof, petition to annex the same to the City. If a petition is not received within the time period, or the property is not annexed as a result of the petition, water service will be immediately terminated without further notice. 6. This agreement shall terminate upon the failure by Owner of said subdivision or of any properties within said subdivision to comply with any !, provision hereof or with any applicable provision of the City Code, ordinances, I rules or regulations, or upon the annexation of said subdivision to the City, and '�, may be terminated by either party upon six (6) months notice by certified mail to the City, or to the property owner(s) within said subdivision. 7. A copy of this Agreement shall be made a part of the Owner's Declaration.
