COUNCIL COMMUNICATION FORM
Engineering & Infrastructure Memorandum
NO. 2006-38
May 30, 2006
TO: Honorable Mayor Osborne and City Council
FROM: Steve Garm ity Manager
Steve Swans P. E., Director of Engineerin & Infrastructure
Matthew C. N well, P. E., City Engineerµ,(,G(
SUBJECT: Water Service Agreement for Deer Run Subdivision
SUMMARY RECOMMENDATION:
It is recommended by staff that the City Council approve the attached resolution authorizing a
Water Service Agreement between the City of Decatur and the property owner/developer of
the Deer Run Subdivision, authorize the City Manager and the Director of Engineering and
Infrastructure to enter into the Water Service Agreement and that the Mayor be authorized to
sign said Resolution, and the City Clerk to attest.
BACKGROUND:
In 1957, the City extended a 12 inch water main along a portion of Turpin Road to provide
water to the Pittsburg Plate Glass Company. As is typical with water main extensions that are
installed beyond City limits, nearby residents periodically request permission to have access
to City water. To service properties not currently within the City limits, a Water Service
Agreement must be entered into between the City and the property owner(s).
In this instance the owner / developer of a 19 lot subdivision has requested permission to
connect to City water and extend a City water main through the subdivision to serve the lots.
Since the Deer Run Subdivision is approximately %z mile outside the City limits a Water
Service Agreement must be entered into between the owner and the City. The agreement is
the standard Water Service Agreement with the exception of an additional requirement that
when any portion of the subdivision becomes contiguous to City limits, the whole subdivision
must annex to the City.
POTENTIAL OBJECTIONS: There are no known objections to this
resolution and agreement.
INPUT FROM OTHER SOURCES: None
