SANITARY SEWER SERVICE AGREEMENT <br /> For and in consideration of the undertakings and covenants set out herein, it is agreed <br /> by and between the Owner(s) of the premises described at paragraph 9 hereof, and which <br /> person or persons are signatory hereto, ("Owner"), and THE CITY OF DECATUR, <br /> ILLINOIS, ("City"), as follows: <br /> 1. The provisions of this Agreement, and the installation, operation and use of the sanitary <br /> sewer service authorized hereby, are expressly made subject to all applicable provisions of <br /> codes, ordinances, rules and regulations of the City, and the Owner agrees to comply <br /> therewith. <br /> 2. The Owner shall provide proof of annexation to the Sanitary District of Decatur for the <br /> premises described herein before the City will issue any tapping, excavation, or inspection <br /> permits. <br /> 3. After completion of the construction of a sanitary sewer main by the City in the street or <br /> roadway adjacent to the premises described herein, and upon obtaining a tapping permit in <br /> the customary manner followed by the City for premises within its corporate limits, Owner <br /> may tap said sanitary sewer main of City and connect a sanitary sewer service thereto to <br /> fumish residential service only to said premises. <br /> 4. Said tap, connection, and service shall be made and installed by a licensed plumber who is <br /> licensed and bonded with the City to work in the right-of-way. <br /> 5. The Owner agrees to pay all sewer service charges to the Sanitary District of Decatur and <br /> the City of Decatur when periodically billed for said services. <br /> 6. At such time as said premises become contiguous to the corporate limits of City, the then <br /> owner of said premises shall, within ninety(90) days after receiving notice from City thereof, <br /> petition to annex the same to the City. If a petition is not received within the time period, or <br /> the property is not annexed as a result of the petition, sanitary sewer service to the premises <br /> will be terminated. In consideration of the City allowing the connection to it's sanitary <br /> sewer, the Owner hereby agrees that any expenses or costs associated with the termination of <br /> the service for any reason under this agreement that the City is required to expend shall <br /> operate as a lien on the property herein described and the City can place a lien on said <br /> property until the costs and expenses have been paid in full and take any and all legal action <br /> allowed to recover said costs and expenses. All costs to restore a sanitary sewer service that <br /> has been terminated shall be at the expense of the Owner. <br /> 7. This agreement shall terminate upon the failure by the Owner to comply with any <br /> provision hereof or with any applicable provision of the City Code, ordinances, rules, or <br /> regulations, or upon the annexation of said premises to the City, and may be terminated by <br /> either party upon six (6) months notice by certified mail to the City, or to <br /> �z,7 � �_ /t/1,c�y„�d fz� l��=t�sr�� =L i�.�z-5� � <br /> if to the Owner. <br />
