SANITARY SEWER SERVICE AGREEMENT For and in consideration of the undertakings and covenants set out herein, it is agreed by and between the Owner(s) of the premises described at paragraph 9 hereof, and which person or persons are signatory hereto, ("Owner"), and THE CITY OF DECATUR, ILLINOIS, ("City"), as follows: 1. The provisions of this Agreement, and the installation, operation and use of the sanitary sewer service authorized hereby, are expressly made subject to all applicable provisions of codes, ordinances, rules and regulations of the City, and the Owner agrees to comply therewith. 2. The Owner shall provide proof of annexation to the Sanitary District of Decatur for the premises described herein before the City will issue any tapping, excavation, or inspection permits. 3. After completion of the construction of a sanitary sewer main by the City in the street or roadway adjacent to the premises described herein, and upon obtaining a tapping permit in the customary manner followed by the City for premises within its corporate limits, Owner may tap said sanitary sewer main of City and connect a sanitary sewer service thereto to fumish residential service only to said premises. 4. Said tap, connection, and service shall be made and installed by a licensed plumber who is licensed and bonded with the City to work in the right-of-way. 5. The Owner agrees to pay all sewer service charges to the Sanitary District of Decatur and the City of Decatur when periodically billed for said services. 6. At such time as said premises become contiguous to the corporate limits of City, the then owner of said premises shall, within ninety(90) days after receiving notice from City thereof, petition to annex the same to the City. If a petition is not received within the time period, or the property is not annexed as a result of the petition, sanitary sewer service to the premises will be terminated. In consideration of the City allowing the connection to it's sanitary sewer, the Owner hereby agrees that any expenses or costs associated with the termination of the service for any reason under this agreement that the City is required to expend shall operate as a lien on the property herein described and the City can place a lien on said property until the costs and expenses have been paid in full and take any and all legal action allowed to recover said costs and expenses. All costs to restore a sanitary sewer service that has been terminated shall be at the expense of the Owner. 7. This agreement shall terminate upon the failure by the Owner to comply with any provision hereof or with any applicable provision of the City Code, ordinances, rules, or regulations, or upon the annexation of said premises to the City, and may be terminated by either party upon six (6) months notice by certified mail to the City, or to �z,7 � �_ /t/1,c�y„�d fz� l��=t�sr�� =L i�.�z-5� � if to the Owner.
