Legal Department Memorandum No. 2006-3
February 15, 2006
Page Two
Based upon the lack of response from Insight and the discussion of Council at
the study session on February 6, 2006, the City has prepared a Formal Needs
Assessment Report, which includes an identification of the needs and interests of the
City, the Needs Assessment study from 2004, the Request for Formal Renewal
Proposal and a proposed Franchise Agreement.
These renewal requirements are consistent with the Cable Act 47 U.S.C. §546.
As contemplated by the Cable Act, the City has prepared a Request for Formal
Renewal Proposal requesting that Insight submit a proposal showing how Insight
intends to satisfy the City's future, cable-related needs and interests in any renewal
term. Insight is also asked to explain why it believes it should be entitled to renewal
and is required to provide certain information that the City will use in evaluating any
proposal. These documents are essentially the same as those provided to you in
September, 2005 when this was previously considered. Since the documents are quite
voluminous, copies are being sent to each of you electronically.
City staff believes that the Report is accurate and adopts the City's needs and
interests.
RECOMMENDATION
Staff recommends that the Decatur City Council adopt the attached Resolution
approving the Formal Needs Assessment Report dated February 21, 2006 ("Report")
and authorizing City staff to send a copy of the Report to Insight.
WLM:pm
cc: John T.
