Legal Department Memorandum No. 2006-3 <br /> February 15, 2006 <br /> Page Two <br /> Based upon the lack of response from Insight and the discussion of Council at <br /> the study session on February 6, 2006, the City has prepared a Formal Needs <br /> Assessment Report, which includes an identification of the needs and interests of the <br /> City, the Needs Assessment study from 2004, the Request for Formal Renewal <br /> Proposal and a proposed Franchise Agreement. <br /> These renewal requirements are consistent with the Cable Act 47 U.S.C. §546. <br /> As contemplated by the Cable Act, the City has prepared a Request for Formal <br /> Renewal Proposal requesting that Insight submit a proposal showing how Insight <br /> intends to satisfy the City's future, cable-related needs and interests in any renewal <br /> term. Insight is also asked to explain why it believes it should be entitled to renewal <br /> and is required to provide certain information that the City will use in evaluating any <br /> proposal. These documents are essentially the same as those provided to you in <br /> September, 2005 when this was previously considered. Since the documents are quite <br /> voluminous, copies are being sent to each of you electronically. <br /> City staff believes that the Report is accurate and adopts the City's needs and <br /> interests. <br /> RECOMMENDATION <br /> Staff recommends that the Decatur City Council adopt the attached Resolution <br /> approving the Formal Needs Assessment Report dated February 21, 2006 ("Report") <br /> and authorizing City staff to send a copy of the Report to Insight. <br /> WLM:pm <br /> cc: John T.
