' . <br /> . <br /> AGREEMENT <br /> J <br /> �1�--� . <br /> THIS AGREEMENT entered into thi .s�� day of �( , 2 ,by and between <br /> the MACON COLTNTY EMERGENCY TELEPHONE SYSTEM BOARD reinafter referred <br /> to as"ETSB")and the CITY OF DECATUR(hereinafter referred to as"City"): <br /> NOW WITNESSETH: <br /> WHEREAS,the parties have esta.blished a MACON COiJNTY ENHANCED 9-1-1 <br /> PUBLIC SAFETY ANSWERING POINT("PSAP"); and <br /> WHEREAS,the Decatur Police Department's Emergency Communications Center <br /> should be the best location for the Primary Public Safety Answering Point(hereinafter referred to <br /> as"PSAP")within the Macon County Enhanced 9-1-1 System; and <br /> WHEREAS,the parties understand that the PSAP is responsible for receiving 9-1-1 calls <br /> that originate from within the Macon County Enhanced 9-1-1 System boundaries; and <br /> WHEREAS, it is understood by the parties that the PSAP may receive 9-1-1 ca11s for <br /> service that originate from areas outside of the County of Macon's boundaries, and in such <br /> situations, without regard to the point of origination of said 9-1-1 calls,the PSAP agrees to <br /> handle said 9-1-1 calls in accordance with the procedures adopted by the ETSB, Statutes of the <br /> State of Illinois and the Rules and Regulations established by the Illinois Commerce <br /> Commission; and <br /> WHEREAS, it is understood that the funding of Enhanced 9-1-1 services derives from <br /> the telephone surcharge as provided for by Illinois law and collected by the ETSB. <br /> NOW THEREFORE, in considera.tion of the mutual promises and covenants hereinafter <br /> recited,the parties do hereby agree as follows: <br /> I <br /> DURATION <br /> This Agreement shall be in effect from the da.te of signing by the parties, through December 31, <br /> 2008, and from year to year thereafter unless either party hereto gives notice of withdrawal as <br /> provided herein. <br /> Notice of withdrawal sha11 be given no less than ninety(90)days prior to the anniversary date of <br /> this Agreement. Such notice of withdra.wal will be sent via registered or certified mail to the <br /> Decatur City Manager or to the Chairman of the Macon County ETSB. Upon receipt of notice of <br /> withdrawal, representatives from the ETSB and the City shall meet within thirty (30) days to <br /> arrange for the hansfer of duties and a disposition of equipment, including both hardware and <br /> software. Both parties agree that it is in the best interest of the citizens of Macon County that <br /> neither will terminate any part of their performance under this Agreement until a date no less ' <br /> than six (6) months after such notice of withdrawal has been received, when the ETSB would <br /> 1 I� <br />
