! � <br /> l ` <br /> ORDINANCE NO. 2005-104 <br /> ORDINANCE AMENDING CITY CODE <br /> - CHAPTER 56.1 - <br /> -RECYCLABLE MATERIALS- <br /> BE IT ORDAINED, BY THE CITY COUNCIL OF THE CITY OF DECATUR, <br /> ILLINOIS: <br /> Section 1. That Chapter 56.1 of the City Code of the City of Decatur, Illinois,be, and the <br /> same is hereby, amended and modified at Section 4, so that said Section 4 as amended, shall <br /> provide as follows: <br /> 4. SERVICE CHARGE. To provide for the expense of <br /> providing a recycling program for the citizens of the City of Decatur, the City <br /> may,by action of the Council, levy a charge on the owners of all dwellings within <br /> the City from which recyclable materials must be collected under the provisions of <br /> any contract as provided herein. Such charge may only be in such amount as will <br /> meet the contractual obligations of the City and provide for other administrative <br /> expenses of the City related to the collection of recyclable materials. The owners <br /> of such dwellings shall be responsible for the payment of all charges levied under <br /> the provisions hereof. The City Manager may, upon public notice in a newspaper <br /> of general circulation not less than 30 days in advance, adjust the service charge in <br /> accordance with the contractual obligations approved by the City Council.
