' ' ' ' Barding Garage
November 13, 2005
Page Two
4. On October 13, 2005 the Zoning Board of Appeals granted a variance to reduce the required
setback for the proposed building expansion at 140 East Damon Avenue from 25 feet to ten
(10) feet and to reduce the required number of parking spaces from ten (10) to five (5).
PROJECT DESCRIPTION
1. The petitioner is proposing to rezone the lot located at 119 East Damon Avenue from R-3
Single Family Residence District to B-2 Commercial District to construct the required
parking area with an accessory storage area and an area to sell used vehicles.
STAFF ANALYSIS
1. The business is currently nonconforming since the approved projects were not constructed.
The proposed building expansion at 140 East Damon Avenue cannot be completed until
off-street parking is provided. The petitioner is willing to provide off-street parking.
2. Sirice the petitioner is requesting to sell used vehicles, the property must be rezoned to B-2
Commercial District as vehicle sales are not allowed in the R-3 Single Family Residence
District.
3. The lot is surrounded by nonresidential zoning districts.
STAFF RECOMMENDATION
1. Staff recommends approval of the request for rezoning with the following conditions:
A site, landscaping and lighting plan for the addition and for the parking area shall
be submitted to and approved by the Economic and Urban Development
Department and the Engineering and Infrastructure Department before building
permits will be issued.
Site screening must be provided for the auto storage area.
PLAN COMMISSION ACTION
2. SectionS:XIX requires the Plan Commission to hold a public hearing on the rezoning reqaest
and then forward its report and recommendation to the City Council for final approval. A
i motion to forwazd Calendar Number OS-60 to City Council with a recommendation for
approval is suggested.
The above report constitutes the testimony and recommendation of the Planning and Economic
Development Division, Economic and Urban Development Department, City of Decatur.
Kathy Miller, AICP
Senior Planner
ATTACHMENTS
l.
