, Excerpts from Plan Commission Minutes of October 6,2005 Cal. No. OS-49 Petition of RANGER ENTERPRISES, INC. for a Conditional Use Permit in the M-2 Industrial District located at 3790 East L and A Industrial Drive to allow above ground storage tanks. Ms. Kathy Miller, Senior Planner,was sworn in by Mrs. Althoff. Ms. Miller presented the recommendation of staff: Currently a 4200 square foot truck wash occupies the 2.54 acre lot. The site is located in an industrial park where most of the lots are vacant. The petitioner is requesting a conditional use permit to allow above ground tank storage on the property. The tanks will store soy diesel, ethanol and other gasoline additives that will be splash blended into transport tankers at the site and then delivered to retail locations. The tanks are all two-hour, fire-rated, double-wall constructed tanks. All above ground storage tanks are regulated by the State Fire Marshall's Office. The existing building will be used to store maintenance parts for the transports and Ranger Enterprise's retail facilities. There may also be an office to facilitate required paper work. The subject property is located in an industrial area. The Splash Facility is located, designed and proposed to be operated in a manner that the public health, safety and welfare will be protected. The location of the above ground storage tanks will not cause injury to the value of other property in the vicinity. The State Fire Marshall will review and permit the above ground tanks. Staff recommends approval of the petition subject to the following conditions: A site plan including a landscaping plan and a lighting plan shall be submitted to and approved by the Economic and Urban Development Department and the Engineering and Infrastructure Department before permits/Certificate of Occupancy will be issued. The tanks shall be screened from the street by a six-foot high site break fence or a six-foot high hedge. Mr. Nordholm questioned on whether there were any concerns with the State Fire Marshall approving and issuing a permit for the above ground tanks. Ms.Miller responded that she assumed the State Fire Marshal will issue a pernut for the tanks. Mr. John asked that if the petitioner chooses to screen the tanks with a six-foot high hedge, how long it will take for the hedge to become six feet high. Ms. Miller responded that the petitioner is going to install a six-foot high site break fence instead of the hedge. Mr. Carabelli,Ranger Enterprises, was sworn in by Mrs. Althoff.
