Excerpts from Plan Commission Minutes of October 6,2005
Cal. No. OS-57 Petition of DANE C. BRAGG,ASSISTANT
CTTY MANAGER,to vacate an easement
located at 3755 and 3795 US Route 51 North.
Mr. Crowe presented the recommendation of staff:
As part of the Mound Center subdivision, the sanitary sewer and watermain were relocated to
facilitate development on the site. The utility easements for the previous location of the sanitary
sewer and watermain need to be vacated.
The sanitary sewer and watermain for the site have already been replaced and new easements
have been dedicated.
The property is owned by the City, therefore appraisals are not required.
Since the existing utilities have been replaced with like services, staff is of the opinion that the
best interests of the City of Decatur would be served by approving the request to vacate the
easement as indicated on the plat. Staff recommends approval of the petition.
There were no objectors present.
It was moved and seconded(Tom Smith/John)to forward Cal. No. OS-57 to the City Council with
the recommendation for approval as submitted by the petitioner. Motion carried unanimously.
