Excerpts of Decatur City Plan Commission Meeting August 4, 2005
Cal.No. OS-40 Petition of A STEP FORWARD,to amend the Special
Use Permit in the R-1 Single Family Residence District
located at 5310 East William Street Road to allow adult
day care.
Ms. Suzy Stickle was sworn in by Ms. Jesse.
Ms. Stickle gave the recommendation of staff:
The Decatur City Council approved the Special Use Permit in May 1993 to allow for the
operation of a privately owned community building. The petitioner is currently utilizing
the facility for an adult day care and workshop for the developmentally disabled. This
location also hosts weekly night activities. There are no known complaints about this
facility from the general public.
The petitioner has requested an amendment to the approved Special Use Permit to allow
for the continuation of the adult day care activities as well as the weekly night activities
that they provide to their developmentally disabled clients as well as clients from other
group homes. This location operates during the day Monday thru Friday and has weekly
night activities that typically end at 9:00 P.M.
The amendment to the Special Use Permit is consistent with the intent of the original
SUP. The activities occurring at this location operate in harmony with the surrounding
neighborhood. The proposed amendment will maintain the current character of the azea
and will not have any adverse affects on the surrounding neighborhood.
The proposed amendment is not consistent with the Decatur Urban Area Land Use Plan;
however, the use of this property is not expected to have a negative impact on the area.
The proposed amendment will have no impact on trc capacity or on utilities.
Adequate parking facilities are provided consistent with the proposed use of the site.
Staff finds the proposed amendment to be consistent with the goals of the Decatur Zoning
Ordinance and the approved Special Use Permit. Based on the above analysis, staff
recommends approval of the petition.
A motion to forward Calendaz Number 05-40 to City Council with recommendation for
approval is advised.
Mr. Anderson questioned the wording in the staff report to read, there aze no known
complaints. Ms. Stickle stated this is how it should be worded.
Mr. Chris Ellis, representative for the petitioner, was sworn in by Ms. Jesse.
Mr. Ellis stated that approval would be very much appreciated.
There were no obj ectors present.
