Mill r, AICP, Senior Planner
SUBJECT: Conditional Use Permit, 308 West Main Street
SUMMARY RECOMMENDATION: Staff recommends approval of the conditional use permit
subject to the following conditions: A site plan including a landscaping plan and a lighting plan
shall be submitted to and approved by the Economic and Urban Development Department and
the Engineering and Infrastructure Department. The Plan Commission reviewed the request at
the August 4, 2005 meeting and recommended approval with a vote of 10 to 0. Plan
Commission minutes are attached.
BACKGROiJND: The Linn House (approximately 5500 square feet) occupies the 18,544 square
foot property located at 308 West Main Street. The building has recently been used as an office
for the Democratic Party and for the Jones and Thomas Advertising firm. Currently there is
parking on the west and north sides of the building.
The petitioner is requesting a conditional use permit to use the structure as a residence and as a
family practice physician's office. Porches and a lift will be added to the structure to
accommodate both uses. The rear portion of the first floor will be used as the doctor's office; the
remainder of the first floor and the second floor will be living space. The office will be
handicapped accessible. The petitioner plans to remove the parking at the rear of the structure
and construct a new three-car garage designed to match the architectural style of the house.
A Conditional Use permit will allow a mixed use--residential and any combination of office
and/or commercial in the same building in an O-1 Office District. The public health, safety and
welfare will be protected and the use will not be detrimental to property values in the
neighborhood. The historical and architectural character of the building will be preserved. The
only changes proposed to the exterior is the addition of porches that match the style of previous
porches located on the structure. A three car garage will be located at the rear of the structure
eight feet from the existing building and three feet from the property line as required by the
Zoning Ordinance.
Adequate parking for the physician's office as well as the residence will be provided on the site.
The side yard parking lot setback of five (5) feet will not be required as the parking lot is existing
and there are no parking lot changes proposed in this portion of the parking lot. The proposed
landscaping meets the requirements of the Zoning Ordinance. The interior of the structure will
retain its integrity as the residential use and the office use will not require a physical separation
