Excerpts of Decatur City Plan Commission August 4, 2005 <br /> Cal.No. OS-39 Petition of DAVID M. DOUGHERTY,to rezone the <br /> premises at 1319-1354 North Water Street from R-6 <br /> Multiple Swelling District and B-1 Neighborhood <br /> Shopping District to &2 Commercial District. <br /> Mr. Greg Crowe gave the recommendation of staff: <br /> The subject property houses a service station with undeveloped land to the north. The <br /> south part of the property fronting Grand Avenue is already zoned B-2 Commercial <br /> District. The petitioner is requesting rezoning the rest of the property north to Waggoner <br /> Street from R-6 Multiple Dwelling District and B-1 Neighborhood Shopping District to <br /> B-2 Commercial District. The service station currently occupies land zoned B-2 and B-1. <br /> The alley that runs to the east of the subject property provides a bazrier between the <br /> service station and Heritage Grove, an independent living facility. <br /> The petitioner is requesting to rezone the property to B-2 Commercial District, so all of <br /> the contiguous land from Grand Avenue to Waggoner Street and west of the alley is <br /> zoned Commercial making the property easier to sell. <br /> The site's surrounding zoning is O-1 Office District to the north and west, B-2 <br /> Commercial District and PD Planned Development to the east. The rezoning is <br /> consistent with the surrounding zoning and land uses. <br /> The rezoning is in hannony with the intent of the Comprehensive Plan and will not have <br /> a negative impact on surrounding properties. <br /> The site fronts US Business 51 North which is part of the Decatur Urban Corridors <br /> Master Plan. The Corridors Plan encourages increased open space and landscaping along <br /> the corridors. The Plan also discourages single use retail/commercial with large surface <br /> pazking. Any change in use,parking design or building additions on the site will require <br /> the property to come into conformance with the requirements of the Zoning Ordinance <br /> which should meet the intent of the Corridors Plan. <br /> The Plan Commission is to make a recomme�ation to the City Council to approve, <br /> 't' n ased on the re uirements of the Zonin Ordinance and the <br /> modify or deny peti io s b q g <br /> Comprehensive Plan. In rezoning petitions, effects of the approved land uses for the <br /> ro osed zonin district on the ublic health safe and eneral welfaze of the City and <br /> P P g P LY g <br /> its citizens need to be considered. <br /> A motion to forward Calendaz Number OS-39 to the City Council with a recommendation <br /> for approval is suggested. <br /> Mr. David Dougherty was sworn in by Ms. Jesse. <br />
