Miller, AICP, Senior PlannerK� <br /> SUBJECT: Orchard Street Vacation west of North Calhoun Street <br /> SUMMARY RECOMMENDATION: Staff recommends approval of the street vacation. Since I <br /> the public right of way does not appear necessary to serve the general public, the best interests of �� <br /> the City of Decatur will be served by approving the alley vacation and reserving an easement for <br /> utility maintenance. The Plan Commission reviewed the request at the June 2, 2005 meeting and <br /> recommended approval with a vote of 6 to 0. Plan Commission minutes are attached. �' <br /> BACKGROiJND: In 1983 the west half of the 900 Block of East Orchard Street was vacated <br /> and in 1987 the 1000 block of East Orchard Street was vacated. North Railroad Avenue between <br /> Marietta and East Condit Street is vacated as well as the alley ways in this block. It is anticipated <br /> that a park will be developed in this area. <br /> POTENTIAL OBJECTIONS: There were no objectors to the alley vacation at the Plan <br /> Commission meeting. <br /> INPUT FROM OTHER SOURCES: Utility letters have been received: an easement for utility <br /> access and maintenance will be required. <br /> STAFF REFERENCES: If Council members have questions they may contact Kathy Miller at <br /> 424-2786 or at kjmiller@decaturnet.org. <br /> BUDGET/TIME IlVIPLICATIONS: An appraisal for the area to be vacated was submitted with <br /> an estimated market value of$1,500. The petitioner will pay the City $1,500 for the property to <br /> be vacated. <br />
