, <br /> (1) When any vehicle is parked on any street, alley or other public <br /> property which lacks evidence of current, legal registration, visible <br /> from the outside of said vehicle. <br /> Section 3. That Section 38 A. (i) and (ii) of Chapter 34 of the City Code of the City of <br /> Decatur, Illinois, be, and the same is hereby modified and amended, so that said Section 38 as so <br /> modified and amended shall provide as follows: <br /> *** <br /> 38. PROCEDURES FOR REMOVAL OF VEHICLES. <br /> A. Except as provided in subsection B hereof, vehicles authorized for removal by Section <br /> 37 of this Chapter shall be removed as provided herein: <br /> (i) A police officer may remove or cause to be removed a vehicle as authorized <br /> herein only after notice that such vehicle may be removed and that the owner of <br /> such vehicle is entitled to a hearing thereon is given to the registered owner <br /> thereof, except as provided in subparagraph (ri) hereof. If the owner of such <br /> vehicle does not appear for a hearing as provided by said notice, such vehicle may <br /> be removed, but not sooner than seven days after such notice is given. If the owner <br /> of such vehicle does appear as provided, such vehicle may be removed immediately <br /> upon notification to the owner that probable cause elcists to believe that the <br /> violation occurred as alleged. <br /> (ri) A police officer may remove or cause to be removed a vehicle as authorized <br /> herein without notice to the owner thereof whenever such vehicle is parked or <br /> abandoned so as to constitute an immediate hazard or obstruction to other vehicles <br /> on or seeking access to public streets or alleys, or so as to prevent or hinder repair <br /> to, or maintenance of, streets or alleys with temporary parking restrictions for that <br /> purpose, or when any vehicle is parked on any street, alley or other public property <br /> which lacks evidence of current, legal registration, visible from the outside of said <br /> vehicle, provided that notice as required in subparagraph(i) hereof is given to such <br /> owner, if the same can be ascertained, within 24 hours of such removal or if a <br /> vehicle is parked or located on public streets, alleys or right-of-ways in violation of <br /> Section 35 (D) of this Chapter. If the vehicle is not currently registered, notice <br /> shall be sent to the most recent registered owner at the most recent registered <br /> address as identified by the Illinois Secretary of State. If the owner of such vehicle <br /> appears as provided within seven (7) days after such notice is given, or within <br /> seven (7) days of removal if no notice was given, as the case may be, and it is <br />
