No. OS-17 Petition of IDEAL AUTO SALES, INC., to rezone <br /> the premises at 2138 East Damon Street from R-2 <br /> Single-Family Residence District to B-2 Commercial <br /> District. <br /> Mr. Greg Crowe was sworn in by Ms. Jesse. <br /> Mr. Crowe gave the recommendation of staff: <br /> The subject site is currently zoned R 2, Single Family Residence District. A main � <br /> residential structure is currently on the site. T'he lot to the east was rezoned from R 2, I <br /> Single Family Residence District to B-2, Commercial District by the City Council on , <br /> February 21, 2005. Ideal Auto Sales was the petitioner in that case as well as being the � <br /> petitioner in the case in front of this body today. Since the lot to the east was r¢oned to I�, <br /> B-2, the petitioner has purchased the subject site and wants to rezone that lot to �2, I <br /> Commercial District to allow for the expansion of its used auto sales lot. I <br /> The proposed expansion would be on Lots 37 & 38 which is across Damon Avenue and I�i <br />' north of the current Ideal Auto Sales lot. The new car lot will have a separate office from �I <br /> the current location. '�I <br /> Auto sales lots are an allowable use under B-2, Commercial District which is designed II <br /> under the Zoning Ordinance to serve the shopping needs of regional geographic areas '� <br /> larger than the B-1, Neighborhood Shopping District and allows a greater intensity of ' <br /> uses. <br /> Based on the increased intensity of use with this rezoning, the Plan Commission needs to I <br /> consider the surrounding uses and compatibility of the rezoning with the Comprehensive �, <br /> Plan. The sunounding zoning includes &2 Commercial District, M-1 Light Industrial I <br /> District and M-2 Heavy Industrial District. The intended land use under the <br /> Comprehensive Plan for the site is commercial. The proposed rezoning to B-2 <br /> Commercial District is compatible with the surrounding zoning and is in harmony with ' <br /> the intent of the Comprehensive Plan. , <br /> In its advisory role to the City Council, the Plan Commission has the options of <br /> approving, denying, or modifying petitions for rezoning. Staff recommends a motion to <br /> forward Calendar Number OS-17 to the City Council with a recommendation for <br /> approval. <br /> Mr. Jeff Justice, representative for petitioner,was sworn in by Ms. Jesse. <br /> Mr. Justice stated that this petition had been brought in front of the Commission <br /> previously and had been obj ected because of a neighbor who had residential property <br /> beside the property to be rezoned. Now this neighbor has sold the property to the <br /> petitioner and that is the reason for the rezoning. <br />
