the Treasurer of the Union as initiation fee, assessment, union dues, and any other mutually <br /> agreed authorized deductions, which sums so deducted shall be accumulated and transferred to <br /> the Union Treasurer on or before seven (7) days after the last pay of the month in which such <br /> deductions are made. If an employee is not due a salary or such salary is not large enough to <br /> satisfy said deductions, no deduction shall be made from the wages or salary of such employee <br /> for that month. The City must be given two weeks notice before any change in deductions is to <br /> be made. <br /> Section 2 (a). Upon the express condition stated in sub-paragraph (b) hereof, and only <br /> upon such condition, the City shall deduct from the wages or salary of each employee covered <br /> by this agreement who is not subject to the wage deduction described in Section 1 of this <br /> Article, and at the same time such deduction is made, an amount certified to the City by the <br /> Union as the fair share of each such employee of the Union's cost relating to the collective <br /> bargaining process, contract administration and pursuing matters affecting wages, hours and <br /> conditions of employment ("fair share deduction"), but such amount shall not exceed the amount <br /> of dues uniformly required of inembers and deducted pursuant to said Section 1 of this Article. <br /> Such amount deducted as provided herein shall be delivered to the Union on or before seven <br /> (7) days after the last pay of the month in which such deductions are made; provided that, said <br /> amount may be paid to a nonreligious charitable organization mutually agreed upon by the <br /> employee and the Union, as provided by law. <br /> (b). No fair share deduction shall be made by the City unless and until the number of <br /> employees voluntarily providing written authorization to the City for the wage deduction provided <br /> for in Section 1 of this Article equals or exceeds 55% of the incumbent bargaining unit <br /> members. <br /> Section 3. The Union shall indemnify the City and any department of the City and hold <br /> it harmless against any and all claims, demands, suits or other forms of liability that may arise <br /> out of, or by reason of, any action taken by the City or any department of the City for the <br /> purpose of complying with the provisions of this Article. <br /> ARTICLE 4 <br /> SENIORITY LIST AND STATION BIDDING <br /> Section 1. A Fire Department seniority list of all employees covered by this Agreement <br /> shall be established based on department seniority. <br /> This list shall be updated on January 1st of each year and said list shall be posted in <br /> each fire station for a period of not less than 30 days commencing January 1 st of each year and <br /> a copy thereof furnished to the Secretary of the Union. Any objections to such list as posted <br /> shall be reported to the Chief of the Department within 10 days of the date of posting or said list <br /> shall stand approved as posted. <br /> Section 2. The selection by employees of their station assignments on each of the <br /> three shifts for the calendar year 2002 and each year thereafter shall be by time-in-grade <br /> seniority, not department seniority, provided the complement of employees assigned to a station <br /> shall have the certifications as specified in Section 3 of this Article. <br /> 4 <br />
