Excerpts of Plan Commission Meeting of Apri17, 2005 <br /> Cal.No. OS-14 Petition of ARCHER DANIELS MIDLAND COMPANY <br /> to rezone the premises located along DIVISION STREET <br /> and 34`� STREET from R-3, Single Family Residence <br /> District and M-1 Intensive CommerciaULight Industrial <br /> District to M-2,Heavy Industrial District. <br /> Mrs. Joselyn Stewart was sworn in by Ms. Jesse. <br /> Mrs. Stewart gave the recommendation of staff: <br /> The subject property is cunently undeveloped and contains approximately two (2)acres. <br /> The petitioner proposes to rezone the property from R-1, Single Family Residence <br /> District and M-1, Intense Commercial-Light Industrial District to M 2, Heavy Industrial <br /> District in order to build a storm water retention pond that would allow ADM's West <br /> Complex to better control storm water runoff. <br /> Upon review of land use and zoning patterns of the azea, staff is of the opinion that the <br /> rezoning will be consistent with the other uses to the immediate east and south of the <br /> property. Despite the fact that the azea to the north and east are developed with single <br /> family structures, the proposed rezoning should not have a negative effect on those <br /> properties. � <br /> The retention pond will be 350 feet by 250 feet and will be 17 feet away from the north <br /> property line. A six foot chain link fence will secure the area and will be locked at all <br /> times. <br /> Based on the above analysis, staff recommends approval of the petition as submitted. <br /> Mr.Nordholm questioned whether the City of Decatur would dictate the depth of the <br /> pond. Ms. Stewart stated that is given to the City by the petitioner. <br /> Mrs. Sadorus questioned if there were overflow mechanism's for this type of pond. Ms. <br /> Miller stated that engineering is involved in making sure it is all within code, during the <br /> site plan review. <br /> Mr. John questioned what type of buffer will be provided. Ms. Miller stated that there <br /> are certain criteria that will be followed. Mr. John asked if this is imposed on industrial <br /> being next to residential and are there any design features such as fencing. Ms. Miller <br /> stated there aze bufferyard requirements verified during site plan review. <br /> Mr. Josh Moore, representative for the petitioner was sworn in by Ms. Jesse. <br /> Mr. Moore stated the purpose of the project was to have a storm water retention pond for <br /> the West Plant, this would enable them to be able to better control the storm water during <br />
