LEGAL DEPARTMENT MEMORANDUM <br /> NO. 2005-06 <br /> February 25, 2005 <br /> TO: Honorable Mayor Osborne and City Council <br /> FROM: Steve Gar City Manager �Q� <br /> Wendy Mo I nd, Corporation Counsel r�` ' <br /> Paul McChan y, Mass Transit Administrator <br /> SUBJECT: Disabled Transit Passenger Appeals Board <br /> SUMMARY RECOMMENDATION: Staff recommends that Council approve an <br /> Ordinance to adopt a new chapter of the City Code, establishing a Disabled Transit <br /> Passenger Appeals Board. Duties of the Board would include hearing appeals of transit <br /> passengers who have been denied certification for paratransit services reserved for <br /> people with disabilities, and assisting staff in developing guidelines and procedures <br /> relative to certifying passengers for these paratransit services. <br /> BACKGROUND: The Decatur Public Transit System provides paratransit services for <br /> its passengers with disabilities as required by the Federal Transit Administration (FTA). <br /> Passengers who wish to become eligible for these paratransit services must be certified <br /> as disabled and unable to use the fixed route bus system. Transit staff establishes the <br /> procedures for the paratransit program, and also makes determinations, with the advice <br /> of inedical professionals, as to who is eligible for paratransit services. One duty of the <br /> Board would be to assist staff in developing new guidelines and procedures. <br /> Anyone who is denied certification for paratransit services, or who has been awarded <br /> only conditional or temporary certification, or who has had their certification suspended, <br /> altered or terminated may wish to appeal that decision. Any appeal today would be <br /> heard by staff members. In the future that function would be handled by the Disabled <br /> Transit Passenger Appeals Board. <br /> POTENTIAL OBJECTIONS: There are no known or expected objections to <br /> establishing this Board. <br /> INPUT FROM OTHER SOURCES: Paul McChancy, Mass Transit Administrator <br /> Richard Foiles, General Manager, DPTS <br /> STAFF REFERENCE: Wendy Morthland, Corporation Counsel <br /> BUDGET/TIME IMPLICATIONS: Transit staff would serve as staff to the Board. No <br /> additional staff would be required. The Board members would serve without <br /> compensation. <br />
