Miller, AICP, Senior Planner��lv <br /> Suzan Stickle,PlannerJS <br /> SUBJECT: Request to rezone to Planned Development at 3253 North Brush College Road. <br /> SUMMARY RECOMMENDATION: Staff recommends approval of the rezoning subject to the <br /> following condition: <br /> A. Phases II, III and IV will be submitted as amendments to the Planned Development and <br /> will have to be heard by the Plan Commission and City Council before any construction <br /> I may begin. <br /> B. The Planned Development will require an amendment should the petitioner wish to <br /> construct additional signage that is not reflected in the Planned Development site plan. <br /> C. A site plan, landscaping plan and lighting plan for each phase shall be submitted and <br /> approved by the Department of Economic and Urban Development and the Department <br /> of Engineering and Infrastructure. <br /> Staff is of the opinion that the proposed rezoning to Planned Development is compatible with the <br /> adjacent land uses in the area. Staff is also of the opinion that the Planned Development will not be <br /> detrimental to the health, safety and welfare of the general public and will not substantially diminish <br /> the value of the properties in the surrounding area. <br /> The City Plan Commission voted 7-0 to recommend approval of this petition at the February 3, 2005 <br /> hearing; the minutes of the meeting are attached. <br /> BACKGROUND: The petitioner is requesting to rezone 3253 North Brush College Road to PD <br /> Planned Development to allow for the construction of an old west themed town and park; the premises <br /> is currently zoned R-1 Single Family Residence District and M-1 Intense CommerciaULight Industrial <br /> District. <br /> The subject site is approximately 26 acres and contains a church, a pavilion, a shed/storage facility, <br /> playground and a youth building. Utilities are available at the site and will be expanded with the future <br /> development. The proposed expansion will occur in four phases with each phase dependent upon <br /> financing. The development is proposed to include various structures (i.e. retail shops, theater, <br /> lodge,petting zoo and office) as well as parking lots to serve the site.
