' , ti v, <br /> ORDINANCE NO. 2004-92 <br /> ORDINANCE AMENDING ZONING ORDINANCE <br /> WHEREAS, on the 4th day of November, 2004, upon due notice, the Decatur City Plan <br /> Commission held a public hearing on the petition of Dane A. Bragg, Assistant City Manager for <br /> Economic and Urban Development, to modify and amend the Zoning Ordinance of the City of <br /> Decatur, the same being Ordinance No. 3512, as amended, at Sections XXI and XXVIII thereof; <br /> and, <br /> WHEREAS, the Decatur City Plan Commission did report its findings and did recommend <br /> that said petition be granted and that the Zoning Ordinance be so modified and amended. <br /> NOW, THEREFORE, BE IT ORDAINED, BY THE CITY COUNCIL OF THE CITY <br /> OF DECATUR, ILLINOIS: <br /> Section 1. That the report and recommendation of the Decatur City Plan Commission be, <br /> and the same are hereby, received,placed on file and approved. <br /> Section 2. That Section XXI.D. of the Zoning Ordinance of the City of Decatur be, and <br /> the same is hereby, amended and modified, by adding a new Section 4 and renumbering the <br /> current Section 4 to Section 5. Said new Section 4 shall provide as follows: <br /> SECTION XXI. EXCEPTIONS TO HEIGHT AND AREA REQUIREMENTS <br /> D. EXCEPTIONS TO FRONT YARD SETBACK REQUIREMENTS <br /> 4. Non-Conforming Porches and Terraces. <br /> An e�sting non-confornung porch or terrace may be replaced or <br /> rebuilt to its current dimensions, provided that the replacement structure does not <br /> project into the required front yard more than eight(8) feet. <br />
