Excerpts of Decatur City Plan Commission <br /> Cal. No. 04-41 Petition of WAKS INVESTMENTS, LLC, to rezone the <br /> premises, located at 3555-3600 North Woodford Street, <br /> and 3592 and 3584 North Charles Street from R-1, Single <br /> Family Residence District and R-6, Multiple Dwelling <br /> District to M-1, Intense Commercial-Light Industrial <br /> District. <br /> Mrs. Joselyn Stewart was sworn in by Ms. Jesse. <br /> Mrs. Stewart gave the following recommendation of staff: <br /> The subject property is currently developed and undeveloped and contains 4.72 acres. <br /> There are two single family structures on the developed property. The undeveloped <br /> property contains 3.21 acres. <br /> The petitioner proposes to rezone the property from R-1, Single Family Residence <br /> District and R-6, Multiple Dwelling District to an M-1, Intense Commercial-Light <br /> Industrial District. The petitioner wants to rezone the property for future development. <br /> Properties sunounding the site are mixed in use. Property to the north is zoned R l, <br /> properties to the east are zoned B-1 and M-1, properties to the south are zoned M-1, and <br /> properties to the east aze zoned R-6, PMR1 and R-1. The Decatur Urban Area Land Use <br /> Plan shows this area as Light Industrial. <br /> Upon review of land use and zoning patterns of the area, staff is of the opinion that the <br /> rezoning is consistent with the other uses. <br /> Based on the above analysis, staff recommends approval of the petition as submitted. <br /> Mr. Steve John questioned staff as to whether we know or have guidelines for bufFering <br /> between residential and light industrial. Ms. Miller stated that a bufferyard is required <br /> adjacent to all residential districts and that buffer yard requirements aze examined during <br /> site plan review. <br /> Mr. Randy Waks, representative for the petitioner, was sworn in by Ms. Jesse. <br /> Mr. Waks.stated that the property was divided into six (6) different tracts, four(4) are <br /> owned by Waks Investments, LLC and the other two (2) aze made up of two (2) single <br /> family residences. Mr. Waks expressed a concern regarding development close to the <br /> single family residences. That is why the adjoining property owners were asked to be a <br /> part of the petition. Both residences are in agreement and are present at the meeting. <br /> No obj ectors were present. <br />
