(d) Environmentally damaging substances. Any substance spilled or released into the <br /> environment in sufficient quantity so as to cause actual or potential human health problems if not <br /> dealt with by remedial action, or to contaminate air, land or water. <br /> (e) Facility. Any building, structure, installation, equipment, pipe or pipeline <br /> including but not limited to any pit, pond, lagoon, impoundment, ditch, landfill, storage <br /> container, motor vehicle, rolling stock or aircraft or any site where hazardous materials or <br /> environmentally damaging substances have been deposited, stored, disposed of, placed or <br /> otherwise came to be located. <br /> (fl Hazardous Materials. Substances or materials in quantity and forms that may pose <br /> an unreasonable risk to health, safety or property when stored, transported or used in commerce. <br /> Such materials include but are not limited to: explosives, blasting agents, poisons, flammable <br /> and combustible liquids, flammable and non-flammable gases, corrosives, oxidizers, organic <br /> peroxides, flammable solids, radioactive materials, etiological agents. Hazardous Materials also <br /> includes hazardous substances and hazardous wastes. <br /> (g) Hazardous Substances. Any substance designated under the Clean Water Act and <br /> Comprehensive Environmental Response, Compensation, Liability Act(CERCLA) (42 USC Sec. <br /> 9601 et. seq.), as now or hereafter amended, as posing a threat to the waterways and the <br /> environment when released. <br /> (h) Hazardous Waste. Discarded material under Resource Conservation and Recovery <br /> Act (RCRA) (42 USC .Sec. 6901 et. seq.) regulated by the United States Environmental <br /> Protection Agency because of public health and safety concerns. ' <br /> (i) Incident defined. A fire, a release or threatened release of hazardous materials or <br /> environmentally damaging substances. <br />
