Miller, AICP, Senior Planner� <br /> Suzan Stickle, Planner,5`l <br /> SUBJECT: Request to vacate Hickory Point Road Estates Final Plat 'I <br /> SUMMARY RECOMMENDATION: Staff recommends approval of the plat vacation petition with <br /> the condition that the original fifteen (15) foot easement recorded at time of plat will remain as <br /> recorded and the forty (40) foot right-of way dedicated to the City will remain as recorded. The <br /> vacation of the plat will not have an adverse affect on the general public. The City Plan Commission <br /> voted 9-0 to recommend approval of this petition at the August 5, 2004 hearing; the minutes of the <br /> meeting are attached. <br /> BACKGROUND: The petitioner is requesting the vacation of the approximately 2.7 acres located at <br /> 1235, 1245 and 1255 West Hickory Point Road. The petitioner would like to vacate the plat to remove <br /> the three lots. The petitioner owns the property to be vacated as well as the abutting property to the ' <br /> south. The petitioner had planned to utilize the three lots to finance church development and has since ', <br /> determined that it is no longer necessary. There are no utilities in the area to be vacated. An appraisal <br /> for the vacation was not required because the petitioner owns the area to be vacated. ,I <br /> INPUT FROM OTHER SOURCES: None <br /> POTENTIAL OBJECTION: There were no objectors to the plat vacation at the Plan Commission , <br /> meeting. <br /> STAFF REFERENCE: Any additional questions may be forwarded to Suzan Stickle at 424-2781 or �, <br /> at smstickle(a�decaturnet.org. � <br /> BUDGET/TIME IMPLICATIONS: None <br />
