Ho d, Human Relations Specialist J ►�� � <br /> Subject: � <br /> Amendment to Chapter 28 Unlawful Discrimination ', <br /> Article 4, Section 4.4 of the Decatur City Code. I, <br /> Summary Recommendation: <br /> This amendment was requested by the Human Relations Commission. I <br /> The amendment to Article 4 of Chapter 28 of the City Code addresses conflicts of interest ' <br /> that may occur between a party filing a complaint of unlawful discrimination with the <br /> Human Relations Commission and the person employed as the Human Relations ! <br /> Specialist for the City of Decatur. Normally, the Human Relations Specialist receives the <br /> initial complaint form, investigates the complaint, and determines whether or not there is <br /> probable cause to hold a public hearing if a settlement agreement can not be reached. In <br /> the event of a conflict of interest,the article as amended stipulates that the City Manager <br /> shall appoint someone other than the Human Relations Specialist to investigate and/or <br /> mediate the matter. ' <br /> Background: <br /> In the recent past, a conflict of interest arose when a previous Human Relations Specialist <br /> employed by the City of Decatur was presented with complaints from individuals who <br /> were terminated from their employment and subsequently filed complaints of racial <br /> discrimination with the Human Relations Commission. The Human Relations Specialist <br /> was previously employed by the same employer charged with the discrimination and was <br /> also involved in the termination of the charging parties—giving rise to the conflict of <br /> interest. <br />
