COUNCIL COMMUNICATION FORM
HUMAN RESOURCES DEPARTMENT MEMORANDUM
Memo #043006
Date: June 30, 2004
To: Honorable Mayor Howley and City Council
From: Steve G , ity Manager
Jerry Bau , rector of Management Services
Jason M. Ho d, Human Relations Specialist J ►
Subject:
Amendment to Chapter 28 Unlawful Discrimination ',
Article 4, Section 4.4 of the Decatur City Code. I,
Summary Recommendation:
This amendment was requested by the Human Relations Commission. I
The amendment to Article 4 of Chapter 28 of the City Code addresses conflicts of interest '
that may occur between a party filing a complaint of unlawful discrimination with the
Human Relations Commission and the person employed as the Human Relations !
Specialist for the City of Decatur. Normally, the Human Relations Specialist receives the
initial complaint form, investigates the complaint, and determines whether or not there is
probable cause to hold a public hearing if a settlement agreement can not be reached. In
the event of a conflict of interest, the article as amended stipulates that the City Manager
shall appoint someone other than the Human Relations Specialist to investigate and/or
mediate the matter. '
Background:
In the recent past, a conflict of interest arose when a previous Human Relations Specialist
employed by the City of Decatur was presented with complaints from individuals who
were terminated from their employment and subsequently filed complaints of racial
discrimination with the Human Relations Commission. The Human Relations Specialist
was previously employed by the same employer charged with the discrimination and was
also involved in the termination of the charging parties—giving rise to the conflict of
interest.
