"Counry" means the County of Macon, Illinois, a body politic and corporate and a unit <br /> of local government and political subdivision duly organized and validly existing under the � <br /> Constitution and the laws of the State of Illinois, and its successors and assigns. <br /> "First Supplemental Indenture" means this First Supplemental Trust Indenture dated as <br /> of July 1, 2004 between the City and the Series 1993 Trustee. <br /> "Government Securities" means the United States Government Obligations described in <br /> Exhibit A attached hereto or any United States Govemment Obligations deposited into the <br /> Securities Trust Fund pursuant to Section 402 hereof following a Subsequent Action. <br /> "Opinion of Bond Counsel" means an opinion of nationally recognized municipal bond <br /> counsel, which counsel and opinion, including the scope, form, substance and other aspects <br /> thereof, are acceptable to the City and the Series 1993 Trustee. <br /> "Refunded Series 1993 Bonds" means all outstanding Series 1993 Bonds presently <br /> outstanding in the aggregate principal amount of$7,210,000. <br /> "Securities Trust Fund" means the trust fund created by Section 201 of this First <br /> Supplemental Indenture. <br /> "Security for the Series 1993 Bonds"means all property and rights conveyed to the Series <br /> 1993 Trustee by the Series 1993 Indenture, other than the Securities Trust Fund. <br /> "Series 1993 Bond Sinking Fund"means the Bond Sinking Fund created by Section 404 <br /> of the Series 1993 Indenture. <br /> "Series 1993 Bonds" means the City of Decatur, Macon County, Illinois Revenue <br /> Refunding Bonds, Millikin University, Series 1993, issued in the original aggregate principal <br /> amount of$9,885,000. <br /> "Series 1993 Debt Service Reserve Fund"means the Debt Service Reserve Fund created <br /> by Section 406 of the Series 1993 Indenture. <br /> "Series 1993 Indenture" means the Trust Indenture dated as of August 1, 1993 between <br /> the City and the Series 1993 Trustee. <br /> "Series 1993 Interest Fund"means the Interest Fund created by Section 403 of the Series <br /> 1993 Indenture. <br /> "Series 1993 Mortgage" means the Loan Agreement, Mortgage and Security Agreement <br /> dated as of August l, 1993 between the City and the Corporation. <br /> "Series 1993 Note" means the $9,885,000 Millikin University First Mortgage Note, <br /> Series 1993 dated August 15, 1993. <br /> -3- <br />
