. � V� . <br /> REAL ESTATE TRANSFER AGREEMENT <br /> 1. THE CITY OF DECATUR, ILLINOIS, a Municipal Corporation, as <br /> SELLER, agrees to convey, and NEIGHBORHOOD HOUSING DEVELOPMENT <br /> CORP., an Illinois not-for-profit corporation, as BUYER agrees to purchase an <br /> unimproved parcel of real property legally described as: <br /> Lot Number 1 of South Side Manor Addition, a Subdivision of <br /> Lot 8 in the Subdivision of the East '/2 of the Southwest '/ of <br /> Section 14 in Township 16 North, Range 2 East of the Third <br /> P.M., and a part of Lot 9 of the resurvey of Lots 9 and 10 in <br /> the Subdivision of the Southwest '/4 of Section 14 in <br /> Township 16 North, Range 2 East of the Third P.M. in <br /> Macon County, Illinois, as per plat recorded in Book 1832, <br /> Page 587 of the records in the Recorder's Office of Macon <br /> County, Illinois, <br /> commonly known as 736 South Martin Luther King Drive, Decatur, Illinois, (the <br /> property), for good and valuable consideration, to wit: Fifteen Thousand Dollars <br /> ($15,000.00). <br /> 2. The Permanent Index Numbers for the property are: <br /> 04-12-14-379-026, and <br /> 04-12-14-379-006 <br /> 3. BUYER acknowledges that SELLER has not furnished a binding <br /> commitment for owner's title insurance policy insuring against defects in the <br /> merchantability of title of the property, and further acknowledges that SELLER <br /> makes no warranties regarding merchantability of title. SELLER shall convey, <br /> and BUYER shall accept such title as is equitably vested in SELLER at the date <br /> of execution of this contract. BUYER acknowledges that SELLER'S interest in <br /> the property is subject to coal and mineral rights if now reserved or conveyed of <br /> record, and easements and building and use restrictions now of record. BUYER <br /> acknowledges that SELLER'S interest in the property may be subject to potential <br /> title defects, including but not limited to any described in an August 4, 2003 <br /> commitment for title insurance issued by Lawyers Title Insurance Corporation. <br /> 4. SELLER shall release all liens and encumbrances against the property <br /> recorded or held in favor of SELLER only, and shall forgive and forbear to pursue <br /> all expenses and costs of maintaining the property up to the date of closing, No <br /> notices, suits or judgments relating to the premises and not described above <br /> have been received by the SELLER except: None. <br /> 1 <br />
