D. Proj ect Closeout/Final Payment <br /> � The City reserves the right to withhold up to the final ten percent (10%) of total <br /> reimbursement on a project until all closeout documentation is received. Closeout <br /> documentation shall consist of: final payout requests, final property inspection sheets, <br /> and certificate of occupancy. <br /> E. Property Standards <br /> Heritage Place at Lakeshore Limited Partnership shall ensure that all housing it constructs <br /> or rehabilitates with city funds meets all applicable local codes, rehabilitation standards, <br /> HLID Housing Quality Standards (HQS), ordinances, and zoning ordinances at the time <br /> of project completion. The owner shall comply with the standards set forth by the City of <br /> Decatur for either new construction or existing residential units, depending on the type of <br /> project it is undertaking. Payout requests for work requiring mechanical, electrical, or <br /> plumbing inspections shall not be processed without documentation that the applicable <br /> permits have been received and required inspections conducted. <br /> F. Termination of Project Funding <br /> The City reserves the right to suspend or terminate payment of reimbursement requests <br /> for a project in whole or in part for cause. Cause shall include the following: <br /> (1) Improper use of funds; <br /> (2) Failure to comply with the terms and conditions of this Agreement, including <br /> those specified in this Section; <br /> (3) Failure to comply with program guidelines. <br /> The City shall notify Heritage Place at Lakeshore Limited Partnership before any such <br /> termination takes place and allow opportunity for review and correction of problems. If <br /> termination of the proj ect is then determined to be necessary, repayment of the total <br /> amount of funds e�pended plus interest on the project shall be made to the City prior to <br /> the end of the City's current fiscal yeaz. <br /> V. AFFIRMATNE ACTION <br /> A. Affirmative Marketing <br /> As specified in 24 CFR 92.351, the owner will develop and adhere to an Affirmative <br /> Marketing plan for its projects. This will consist of actions to provide information and <br /> otherwise attract eligible persons in the housing market area to the available housing <br /> without regard to race, color,national origin, sex, religion, familial status or disability. <br /> The Affirmative Marketing plan shall be submitted to the City prior to the payout of any <br /> reimbursement requests under this Agreement. <br /> B. WBE/MBE <br /> The owner will use its best efforts to afford minority and women-owned business <br /> enterprises the maximum practicable opportunity to participate in the performance of this <br /> contract. As used in the contract, the term "minority and female business enterprise" <br /> means a business at least fifty-one percent (51%) owned and controlled by minority <br /> group members or women. For the purpose of this definition, "minority group members" <br /> are Afro-Americans, Spanish-speaking, Spanish surnamed or Spanish-heritage <br /> 3 <br />
