Miller,AICP, Senior Plannerll..D�Y'(� <br /> Greg Crowe, Economic Development Coordin�t�`�� <br /> SUBJECT: Grant of Easement— 141 North Main Street <br /> SUMMARY RECOMMENDATION: Staff recommends approval of the attached resolution <br /> authorizing a 336 square foot easement to be granted to the Lincoln Square Theatre to permit the <br /> placement of two fire escape structures on property owned by the City. <br /> BACKGROUND: The Theatre proposes to construct two fire escape ladders attached to the rear of <br /> the building. The area in which the fire escape would be located is a portion of a lot that connects to <br /> the Main Street alley and is owned by the City of Decatur. The alley supports vehicular traffic and <br /> provides rear access to various buildings in the downtown block. The proposed structures would not � <br /> interfere with, or prevent, access t any of the buildings that front the property. <br /> Emergency access would be maintained to buildings along the alley and the City would reserve the <br /> right to use the alley for the construction of infrastructure and/or public safety improvements. The <br /> developer will be required to obtain building permits for construction within the easement. <br /> The proposed fire escapes are critical for the Theatre's ability to rehabilitate the building within the <br /> existing building code requirements. There is no foreseeable negative impact of granting the easement <br /> on the subject property. <br /> INPUT FROM OTHER SOURCES: The easement documents have been reviewed by the <br /> Department of Engineering and Infrastructure <br /> POTENTIAL OBJECTION: There were no objectors to the petition at the Plan Commission <br /> meeting. <br /> STAFF REFERENCE: Any additional questions may be forwarded to Greg Crowe at 424-2725 or at <br /> gccrowe(a�decaturnet.org. <br /> BUDGET/TIME IMPLICATIONS: City staff has recommended to the petitioner a fee of$1.00 per <br /> square foot of easement area, or$480.00, as appropriate compensation for the use of the easement. <br />
