� ' <br /> � � . <br /> ' � Soules Bird Repelent Company <br /> ♦♦♦ <br /> 214 E.Mound Road�Decatur,Illinois 62526 <br /> Phone 217-877-6553 <br /> AGREEMENT <br /> AGREEMENT made by and between the City of Decatur, Illinois, a municipal <br /> corporation ("City") and Soules Bird Repelent Company ("Soules"). <br /> For and in consideration of the premises set out herein,the City and Soules agree as <br /> Follows: <br /> 1. Soules shall provide bird repellent services to all properties owned by the City located <br /> within the boundaries set out in paragraph 2 hereof. Said services shall be those determined to be <br /> necessary in the sole discretion of Soules to eliminate the noisome and unsanitary accumulation <br /> of birds on City property;provided that, such services are in strict compliance with all applicable <br /> Federal, State and City statutes, ordinances,rules and regulations, including but not limited to <br /> environmental and conservation laws, and further provided that such services do not constitute a <br /> nuisance to abutting property owners or the public. <br /> 2. The area within which Soules shall provide bird repellent services, as discussed above, <br /> is that area bounded by Cerro Gordo Street on the north, Franklin Street on the east, Wood <br /> Street on the south and Church Street on the west. <br /> 3. The bird repellent services to be provided by Soules, as required hereby, shall begin <br /> not later than October 1, 2005 and shall continue through September 30, 2008. <br /> 4. The City shall pay Soules for the services described herein at the following rates, and <br /> according to the following schedule, except as provided in paragraph 5 hereo£ <br /> October 1, 2005- $14,000, for the period October l, 2005-September 30, 2006 <br /> October 1, 2006- $14,000, for the period October 1, 2006-September 30, 2007 <br /> October 1, 2007- $15,000, for the period October 1, 2007-September 30, 2008 <br />
