' • .. } <br />� AGREEMENT FOR TEMPORARY USE OF LAND <br /> The undersigned, City of Decatur Illinois a municipal corporation , of the <br /> County of Macon , and State of Illinois , party of the first part, for and in <br /> consideration of the sum of Ten and 00/100 Dollars 10.00 , in hand paid, the <br /> receipt of which is hereby acknowledged, and in consideration of the covenants <br /> contained herein, hereby represent that they own the fee simple title to and hereby <br /> permit and license the County of DeWitt, State of Illinois, their assigns and it's or their <br /> representatives, engineers, agents, contractors and employees, party of the second <br /> part, to enter upon the following described land for the purpose of constructing an <br /> entrance : <br />' A part of the Northwest Quarter of Section 36, Township 19 North, <br /> Range 3 East of the Third Principal Meridian, described as follows: <br /> A tract of land 5 feet in width tying befinreen Station 50+30.00 and Station <br /> 50+75.00 a distance of 45.00 feet along the east side of t�e proposed <br /> east right of way line of a highway designated as Construction Section 85- <br /> 00043-00-RS, as surveyed and staked out under the direction of the <br /> Dewitt County Highway Department. <br /> All of the above excludes that portion now in use as a public road. Said <br />' tract being shown by the plat hereto attached and considered a part <br /> hereof. <br /> The permission and license shall terminate on the 31st day of December , A.D., <br /> 2007 , or on the completion of the said Construction Section 85-00043-00-RS, whichever is <br /> the sooner. <br /> The party of the first part and the party of the second part do hereby agree that the <br /> party of the second part may and is hereby granted the right, easement and privilege to enter <br /> upon the above-mentioned land, with the necessary equipment to construct the highway and <br /> to remove any fences, road building materials, trees, growths and brush therefrom and may <br /> use the same in such a manner and at such locations as the party of the second part may <br /> deem proper, needful or necessary, in the construction of the highway. <br /> The party of the first part and the party of the second part do hereby agree further that the <br /> party of the second part will return the property of the party of the first part to it's original <br /> Page 1 of 2 <br /> i � <br />
